To think this shouldn't result in a prison sentence

I've read that idiot who showed the picture of that poor little boy at the football match is facing jail. Showing that picture was incredibly cruel, nasty, spiteful and many other things. That poor boy suffered with cancer and his family lost him so young.
However I do not believe this man should go to jail for showing the image. He rightfully deserves to be named and shamed, cautioned, possibly banned from future matches. But I don't understand why he should be going to prison over it.

He has, today, guilty, sentencing next month. The judge said all sentencing option are open, including prison.

Maybe he’s got a record the length of war and peace. Without all the relevant information how can anyone say what the appropriate sentence is here?

He's got a "minor unrelated incident which resulted in a fine" on his record was the info given by his solicitor today.

Bailed to return on 17 November for sentencing. His actions were terrible but things would have been much worse if his actions had incited a riot. They will want to make an example of him.

As I said I did say for a hospice not in a hospice. I was thinking of fund raising or working for a charity, that sort of thing. But prison is not the only alternative if that is not appropriate. There are other sorts of community service e.g. scrubbing graffiti. But the prisons are currently full to overflowing - it costs £40,000 to send someone to prison for a year which is coming out of our taxes, and people often come out in a worse state than they went in.

Nasty thing to do but there are people out there who have committed violent acts against others and been "spared jail" (I HATE that term) despite have a long record of similar offences so no, I don't think he should be jailed . Heavy fine and community payback more appropriate IMHO

I agree @Codie22345. Not a custodial sentence. He needs to spend time in a children's hospice and listen to families who have lost loved ones to cancer, and to hear about what it feels like. He has a chance of learning something that way.

im not sure people who do the kinds of things he did learn empathy, by listening to heart broken families and I don't think it's worth their emotional distress to try to teach him empathy.

I would imagine the judge has said jail is a possibility to let the idiot stew on it in the hopes of him not repeating thus behaviour on future

Tragedy related insults etc are becoming a larger issue at football matches though with the CPS having had to issue guidance to the FA etc so it is possible they may make an example of him

Tensions and emotions run high at football matches, as someone else said it could have ended up as a riot, at fucking Hillsbrough of all places as well

You can’t let someone like that near ill children and their vulnerable families just to teach him a lesson he should already know— how to behave like a decent human being.
A few hundred hours of scrubbing pavements, on his knees, with a toothbrush might come near to a punishment.

Probably not in reality but that is for a judge to decide. If I were on the jury and it was an option I would go for it for this sort of crime though. So many people were hurt by his actions, it wasn’t just a one off thing

It's probably fortunate then that juries don't get to decide sentencing!

Trial by media yea what he did was awful but doesn’t deserve jail time especially when sentences for men who access child pornography or sexual abuse get off with suspended sentence and community orders

I agree with you OP. He's been identified by the media, lost his job and will likely face a long an from football grounds. Incredibly stupid, hurtful and rotten thing to do but if we start locking people up every time they do vile, nasty things, we'd soon run out of prison space.

We're already out of prison space, many should be closed due to the state of the buildings & as we are wayyyyy over capacity, we don't need to be letting others out early to accommodate slime like this.

I think actually his life will be a lot more ruined by the public shame around this than it would be by going to prison. Every time he tries for a new job, his name will be googled and it will come up. It will always be known about him locally and people will ostracise him and if he moves it will only be a matter of time before someone else finds it on google. Even if he does manage to grow up at some point, he won't be able to leave it behind.

Both @MyCircumference people associated to him (the local footy team he played for for example) have dropped him like a hot rock - who would want to be associated with him.

The other kid laughing like a hyena stood next to him is his brother! Parents must be utter scum to have raised them.

He could have started violence during the match and he knew he could have by upsetting so many people. He knew exactly what he was doing, coked up or not.
