To think this shouldn't result in a prison sentence

I've read that idiot who showed the picture of that poor little boy at the football match is facing jail. Showing that picture was incredibly cruel, nasty, spiteful and many other things. That poor boy suffered with cancer and his family lost him so young.
However I do not believe this man should go to jail for showing the image. He rightfully deserves to be named and shamed, cautioned, possibly banned from future matches. But I don't understand why he should be going to prison over it.

Sentences should be applied appropriately and consistently.

If you don’t care that someone could be given a prison sentence for something usually not warranting a custodial sentence because they’re a dick, what about the next time when it’s someone who’s a bit less of a dick? And the next time?

A system based on punishments applied based on character rather than crime is incredibly dangerous.

UndercoverCop · 02/10/2023 19:40

Custody is within sentencing guidelines for a public order offence, there are aggravating factors to this. If he's not previously convicted that will be taken into account. I'd bet quite a lot of money on the opposite being true. If he's currently subject to another sentence or very heavily convicted for similar etc that will also be taken into account at the point of sentence.

SomeCatFromJapan · 02/10/2023 19:42

I'm really torn. I'm not sure prison is appropriate just in terms of setting a precedent but my god, what a truly vile, dispicable way to behave.

Iheartmysmart · 02/10/2023 19:43

He’s a pointless piece of shit and hopefully this will follow him around for the rest of his life.

nonumbersinthisname · 02/10/2023 19:43

Football has got a bit rowdier since the return after lockdown, specifically an issue with coked up young men/ultras going OTT with their “support” and goading of opposition fans. Getting drunk at matches is seen as an old man’s thing now.

The Premier League and EFL have done a lot to make football a more family friendly event, with police support. So incidents like this get cracked down on hard. Last season there was a spate of chucking objects on the pitch. Before that, fans getting on the pitch. From what I can see at our club, there’s actually a fair amount of peer pressure to keep a lid on it, and last time someone chucked something on the pitch a load of people round them stood up and pointed at them and got the stewards in to pull them out while people booed them out.

Elmagr10 · 02/10/2023 19:44

I’m a Sunderland fan and was at the game on Friday in the away end.

The picture of Bradley was shown by this cretin in response to a picture of a Sheffield United badge. I cannot imagine how Bradley’s family felt seeing this and reading about it. Especially the WhatsApp’s which cemented his views and the fact he repeated in his police interview he found it funny and that he was coked up to the eyeballs.

This grown man mocked a child who died, openly and without remorse. Fuck him. Deserves all he gets

JohnnyYenSetHimselfOnFireAgain · 02/10/2023 19:44

He's a first class gobshite who clearly will do anything for 'banter points'. He deserves everything that comes to him and, hopefully, Sheffield Wednesday ban him for life.

bellac11 · 02/10/2023 19:54

I dont know much about football stands or grounds but presumably, he gets his phone out, with a picture of the child on it, showing it to who?

Surely he is surrounded by his friends/fellow supporters, what impact was he aiming to have on the other teams supporters when presumably they were on the other side of the stadium?

Did he give any explanation?

Elmagr10 · 02/10/2023 19:57

He was close to Sunderland fans. Segregated by a corner. Close enough for someone to photograph him holding his phone up

Oh for the love of god do some googling.

He’s a wrong un, no cozy explanations.

Yes, he gave an explanation

And that explanation was he was high on cocaine when he did it

He won’t go to prison, but I don’t think that matters really. The biggest punishment is his face is every where & everyone knows what a massive cunt he is.

Yeah, I agree. He has let the whole country know that he is a worthless piece of shit. He would come out of prison after a month or two just as vile. I hope his neighbours let him know what they think of him.

Saker · 02/10/2023 18:23

I agree with you OP, it would be more productive to make him do community service for a hospice or similar. Sending people to prison rarely achieves anything.

People who need hospice care are vulnerable enough without inflicting bastards like this on them.

Theunamedcat · 02/10/2023 20:04

There is plenty of poo picking that can be done by him

I agree.

Scum. The parents have been through enough and this must have hurt them so much.

Make an example of him and put him in prison for a few months.

ChesterDrawz · 02/10/2023 20:10

@Codie22345

But I don't understand why he should be going to prison over it.

You seem to have picked up on one part of what's been said.

The judge told him that all sentencing options are available for the offence he pleaded guilty to, including prison.

That's no different to many other offences. It doesn't mean the offender is actually going to go to prison.

Why are you being so aggressive, OP starts a thread with virtually no details, I know nothing about this and am asking quesstions. I dont know what you mean by 'cosy explanations', Im interested in what he said as presumably its unfathomable no?

Yes the judge simply has to set out all the options available to the court.

I think things like poo picking as suggested are more effective plus some sort of programme or course where victim impact understanding is learnt (although they probably dont exist or have been cut)

He was high on drugs - cocaine
And he thought it was funny.

However, he told the judge he is very disappointed in his behaviour and now knows it was a terrible thing to do - or something like that. I suspect his solicitor told him to say that.

NotSuchASmugMarried · 02/10/2023 20:15

The point of prison isn't just to punish someone for their crime, it's also to put them behind bars so that the rest of society can be safe.

Is it really safe for that man to be out in the street, mixing with decent people, when he does things like that?

DarkDarkNight · 02/10/2023 20:17

I won’t shed tears if he gets a prison sentence but when men are routinely being let off when they are found with child abuse images it seems that things have gone awry.

It was a pathetic and disgusting act though. I think the football ban is a good idea, along with a big fine, enough to impact his lifestyle. I don’t know about their background and age and if they have kids of their own but it was really cruel. I doubt pondlife like them would be very moved by a victim impact statement from Bradley’s family would they?

Againstmachine · 02/10/2023 20:21

It isn't just the photo it's the fact it was aimed at Sunderland fans and a incitement to violence.

That said reading internet forums and seeing the threats against his family, friends, mistaken identity I think a fair few football fans need pulling in too.

With this idiots and the response by many of people threatening his family football fans are looking complete morons.

itsaquarterafterone · 02/10/2023 20:25

I keep thinking about the little boys parents. I just can't get my head around anybody doing this.

I'm sorry OP but I could never have started this thread no matter what my views on his punishment was.

Brefugee · 02/10/2023 20:26

I'm a Sheffield Wednesday fan and am appalled. I hope he gets the harshest sentence allowable, it should act as a deterrent. I've contributed to the fund set up by the Wednesday women's club and a lot of my friends have done the same.

Frankly? The stewards need to chuck drunk/drugged/high people out of the ground. I'm in Germany. We are allowed to actually take beer to our seats. That kind of drunkenness would never be allowed.

BandicootCrash · 02/10/2023 20:30

The concept of facing jail time for "outraging public decency" makes me very nervous; it seems like it could flex to almost anything the powers that be don't much like.

I may be behind on this one already though- if they've decided to prosecute on grounds of incitement to violence or something (trying to stir up trouble in a notoriously volatile situation) then that would be different.
