Why is everything about suing these days?
He’s saying she crashed into him whilst being distracted by her kids. So it was an accident then? It’s not like she ploughed into him on purpose or crashed into him whilst drunk or high … it was an accident

She’s saying he crashed into her by accident and is counter suing him.

AIBU to think this whole suing culture for genuine accidents needs to stop?

At a guess I would say it's for his medical bills America is shocking for healthcare and I'm guessing that's part of the reason for him suing her can't stand the woman but also agree this culture of suing people for nothing is ridiculous and sadly the uk is going the same way greedy lawyers encourage this crap so much.

I saw a documentary about that case that often gets referred to about the woman who sued McDonalds over the hotness of their coffee. It sounds frivolous but the alternative was being bankrupted by medical bills as she had had a long hospital stay with skin grafts. I think Medical bills in America can drive a lot of litigation.

however:

I know somebody who stepped in front of a taxi, got run over and the taxi driver sued her for damage to his motor! She was already dealing with a broken leg’ We did all feel that if he hasn’t seen her coming out the prestigious investment bank where she worked. He would not have bothered!

Because it’s cost him hundreds of thousands of dollars. He suffered a brain injury and multiple broken ribs, it’s not like he had a grazed knee 🙄You can’t just go around not looking where you’re going and seriously injuring other people and costing them their livelihoods. It’s not a new concept either, it’s been around for hundreds of years.

He's suing for an acknowledgment of wrongdoing he says.

He says she knocked him over, stood up and skiied off without a word and without rendering aid which isn't allowed. Apparently you are obligated to stop. Otherwise people would be left dying on mountains I suppose.

He's 'only' sued for $300000 I think which isn't much in the grand scheme of things,

His daughter said in her testimony that since the accident he's become obsessed with getting GP to say it was her that skiied into him.

I can imagine being in a situation where someone said I'd done something that I hadn't done, wanting people to know I hadn't done it! And it seems that's what he wants. It doesn't seem to be about money.

Skiing into someone is not an accident it is negligence. Bit of debate over whether it was GP or the bloke who crashed into the other, though.

@BringCathyBack do you’d be be happy paying hundreds of thousands for your own medical bills and living with life changing injuries because someone else wasn’t paying attention?

it’s not an accident - it’s distracted inattention. She should have been concentrating on what she was doing. She didn’t and so some one else ended up with life changing injuries and enormous financial losses as a result of her carelessness.

So if someone knocked you over and it cost you the amount of money your house was worth to go to the doctor you would just sell your house and live on the streets or move back in with your parents because the person who knocked you over wasn't rich?

  • to cover medical bills
  • extremely frustrating to have someone outright lie about what happened. She's saying he skiing into her from behind, and she momentarily thought it was a sexual thing. I mean, really?!

Imo she's a spoilt brat who thinks she can get away with it. I'd be chasing it to the bitter end too.

What about every other person who gets into a skiing accident. In any other country. If they fall over and take you out. You have no come back against them, normally.

There was similar where an aunt sued her 12 year old nephew for breaking her arm. The papers were outraged but the whole thing was about trying to get their insurance to pay the medical bills.

He was suing for $3m and a previous judge threw out the majority of his claims. The only remaining claim is for acknowledgment of wrongdoing. This has been going on for 6 years and most of his symptoms were in existence following a stroke prior to the accident, now exacerbated by age. He’s suing her for ageing. He was taking part in a high risk sport with full insurance as a partially sighted 70 year oldwho had previously suffered a brain injury- risk upon risk. He didn’t see her coming. His medical witness is a friend of his, and not a trauma or brain injury specialist.
he’s suing her because she’s rich. The only independent/ not related witness skied over and the first thing he said was “you just took out gwyneth Paltrow” which is weird language to use if she skied into the back of him.

Skiing is an expensive hobby - who does that without insurance?

But yeah - if she caused the injuries (negligence or accident or intentional) which put him hundreds of k into medical debt then why shouldn't she cover it?

Sorry that was supposed to say, if you go skiing in any other country say France or Italy and someone takes you out what's on my falls over and take you with them generally you don't have any comeback against this.

Firstly, this was in America. Secondly, she is very rich and he knows this and thirdly he was actually badly damaged.

But generally in life, there is very little little come back. If somebody does shoe an accident is a very fine line between it been an accident and negligence.

What if you fell over while skiing, would you expect someone to sue you?

I saw a photo of her in court and she this sour smirk on her face. She looks like she expects to wipe the floor with judge 🙁
