So, if she'd startled the cyclist with a loud sneeze instead?

Of course she wouldn't but that's a completely different scenario so not relevant.

Logicoutofthewindow · 02/03/2023 16:05

How is it an accident @Nooyoiknooyoik ?

"A "territorial" pedestrian whose actions killed a 77-year-old cyclist when she was angered by her being on the pavement has been jailed.
Auriol Grey, 49, shouted an expletive and gestured in an "aggressive way" towards Celia Ward, who fell into the path of a car in Huntingdon in 2020." Seems pretty aggressive towards older woman who then FELL INTO THE ROAD AND INTO A CAR....

"Everyone will have their own views of cyclists on pavements and cycleways, but what is clear is Grey's response to the presence of Celia on a pedal cycle was totally disproportionate and ultimately found to be unlawful, resulting in Celia's untimely and needless death.

So the woman was jailed after a jury found her guilty - yet here we have MN user(s) finding it unnecessary.... the woman was vile to the cyclist - read it and watch the audio which resulted in a death that should not have occurred.

ClaraThePigeon · 02/03/2023 16:05

Totally the cyclist at fault. Going to fast, unaware of potential dangers.

You can see from the video that she wasn't going fast and there was still room.

Nooyoiknooyoik · 02/03/2023 15:36

Ah ok, I looked for a discussion but couldn’t find it. Thanks.

Someone died but it was an accident. Pure and simple. Accidents do happen.

Thank god I’ve never accidentally shouted and sworn at someone causing them an accident, ooh wait, that isn’t something that would be an accident, it’s a conscious decision.

SpinningFloppa · 02/03/2023 16:06

I don’t think it was an accident, however there was a similar story where a woman bashed her trolley into an elderly man and he died and she wasn’t sent to prison even though she caused his death and actually was much worse as she physically rammed into him.

AllDayBreakfast92 · 02/03/2023 16:03

So, if she'd startled the cyclist with a loud sneeze instead?

She seems pretty vile but it seems all, hse did was say "get off the fucking pavement".

Well a sneeze isn't an aggressive and intentional act. Had the cyclist been startled into the road by a sneeze, that would certainly have been an accident.

AngeloMysterioso · 02/03/2023 16:06

Having watched the video several times, it sure as hell looks like she pushed her to me…

MissyB1 · 02/03/2023 16:06

ancientgran · 02/03/2023 15:45

Considering the judge seems to refer to road users when the incident was a pavement and states it was a cycle path when the police and council can't confirm that I don't have great confidence in his judgement.

Precisely this! So now we have to accept cyclists on the pavement coming straight at us, don’t say a word, just suck it up or you will find yourself in prison. Insane!

Oh and if you are pushing a pram, you had better put the pram in the road, after all the cyclist clearly has priority on the pavement 🤦‍♀️

Yes I think people are misunderstanding the manslaughter term.

People on here always misunderstand manslaughter to a point I think they do it on purpose. It's always massive discussion either "but it was an accident😭 the justice system is joke" or "how come it's not a murder😤the justice system is a joke". Just refusing to accept other situations exist

Trez1510 · 02/03/2023 16:07

AllWorkYoPlait · 02/03/2023 16:02

Why would the driver be charged? That WAS an accident. There was no way they could've stopped. Pedestrian was completely reckless.

That poor driver probably has PTSD as a result of the incident, unlike the sauntering shopper.

I'm too old to speculate on court cases based on media reports. I trust the jury and judge were privy to much more information than the media share with the rest of us, hence the decision/sentence.

FourTeaFallOut · 02/03/2023 16:08

Yes, she was vile. If being vile were a crime the prisons would be over flowing. Could she have reasonably expected her vileness would contribute to the cyclist's death? I don't think so, I think what followed seemed to be an accident.

murasaki · 02/03/2023 16:08

OK, thanks for clarifying the the car driver, I'm a non driver so wasn't aware of how it works in this sort of case.

Crikeyalmighty · 02/03/2023 16:08

I don't agree with this either- as someone else said, it was an accident

IHaveaSetOfVeryParticularSkills · 02/03/2023 16:08

AngeloMysterioso · 02/03/2023 16:06

Quite, but that is unfortunately a speculation which we will never confirm or deny.

Please could you say exactly where the video has this? I have seen video but nothing that indicates this.

RainbowBrightside · 02/03/2023 16:09

Her actions directly caused the death of someone else. She 💯 deserves to be punished. Should she get a medal or something? 🙄 🙄

NoBoatsOnSunday · 02/03/2023 16:09

What a scumbag. Absolutely deserves to be in prison.

Mariposista · 02/03/2023 16:09

oldwhyno · 02/03/2023 15:48

You can't go scaring people into evasive action that causes an incident that kills them. It's an appropriate sentence to my mind, and she probably won't serve that long.

Yep. This. She will think twice about being a rude little shit in future.

Fizzadora · 02/03/2023 16:11

Strawberrysosweet · 02/03/2023 15:33

She caused the death of a woman!

No she did not. The woman was riding illegally on the pavement and is therefore responsible for her own death. Its what's called an accident.

FourTeaFallOut · 02/03/2023 16:11

Is there more than one camera demonstrating the incident? Because what I saw looked like the gesture that you make in exasperation. It didn't look like a push.

CMO · 02/03/2023 16:11

Nooyoiknooyoik · 02/03/2023 15:36

Ah ok, I looked for a discussion but couldn’t find it. Thanks.

Someone died but it was an accident. Pure and simple. Accidents do happen.

I don't know how you can come to that conclusion without all the facts. A jury of your peers clearly felt she was guilty.

Abouttimemum · 02/03/2023 16:11

All she had to do was step aside and let the cyclist pass. There’s no need to be so bloody angry and aggressive so yeah she deserves the sentence. It wasn’t an accident. Imagine watching someone die and just wandering off to do your shopping. Jesus.

Hopefully it’s a lesson for others just to be a bit more considerate.

AllDayBreakfast92 · 02/03/2023 16:11

ClaraThePigeon · 02/03/2023 16:05

Of course she wouldn't but that's a completely different scenario so not relevant.

Seems pretty relevant to the comment I was replying to. She's presumably being sentenced for causing the death rather than using a profanity

Her actions caused the victim to fall into the path of a car. She may not have intended to kill her, but she caused the accident.

HooverIsAlwaysBroken · 02/03/2023 16:11

Yet the bicyclist who caused the death of a woman only got 18months

amp.theguardian.com/lifeandstyle/2017/sep/18/cyclist-charlie-alliston-jailed-for-18-months-over-death-of-pedestrian

I don’t know anything about this case but bicyclists have often almost cycled into my children. And if on a pavement, the should go slow.

ClaraThePigeon · 02/03/2023 16:12

Would it have been my fault if he got hit? Or should us pedestrians now be expected to act as a buffer to entitled cyclists so they don't get hurt but we are

I get annoyed, very annoyed, with inconsiderate cyclists on the pavement and I have disabilities that make it harder for me to get out of the way, and I live in an area where there's a lot of them, it's often used for training by professional cyclists and I also live on a popular walking trail, but whether they should be there or not I don't get to respond aggressively and endanger them. It's not a free pass to behave as I wish. Besides this may have been a shared use path. That hasn't been established yet(That I'm aware of)
