A man has raped a child and walks free from court as the judge appears to blame the child.

Maybe he thought she had a house and car because parents were absent. I was also confused by that.

Whole thing is odd because I understand 14+ presenting as an adult but 12 could've been in year 6 in summer last year. Shock

MonsterSister · 25/01/2022 19:57

It seems unbelievable a 19 year old could mistake a 12 year for 16 but that seems to be the accepted facts of this case

My very embarrassed 12-year-old was repeatedly asked what subject she was applying for at her older brother’s university open days.

When he moved into uni at 19, she was 13, and mistaken twice for being the student moving in (someone even asked if he was her younger brother).

At the wedding of one of MY friends, in our 40s, she was asked if she knew the bride from uni.

She tells me she has never, ever, been challenged for ID in a pub. She’s still under 20. And very pissed off.

People are thick.

You’d think it would open up a can of worms with pedophiles world wide who have groomed and sexualised children of all ages… so will they blame them? Children as young at 2 know right from wrong, so why wouldn’t an immature 20 year old man?

This is all kinds of wrong.

This is not the case here though. No grooming was involved.

The girl wasn't blamed. Not by the judge. Not even in the articles.

Who said he doesn't know right from wrong.

He didn't think he was doing anything wrong because as far as he knew she was 20 with her own house and her car.

Even the prosecution accepted he genuinely thought she was well above the age of consent.

It isn't about right and wrong though, of course he knows sex with a 12 year old is wrong. It's about whether it was reasonable he believed she was old enough to consent.

Don't paedophile usually go the opposite way - pretend they're younger not convince the 12 year olds to portray themselves on SM as adults? Doesn't that rather put them as not being the same age as their victim?

SleepingStandingUp · 25/01/2022 20:41

Even the prosecution accepted he genuinely thought she was well above the age of consent. this is an important point I meant to comment on earlier. It isn't just his defence saying oh yeah, he thought she was older. Even those prosecuting him for rape, concede the point in the reality of how old she appeared.

whiteworldgettingwhiter · 25/01/2022 23:54

@cabbageking - she wasn't sleeping in the car. He was! Read the article.

alexdgr8 · 26/01/2022 00:50

@Omicrone

Are 16 year old girls generally out there looking for sex on Tinder? Surely that would be a red flag for that bloke in itself?
apparently she said she was aged 20 on tinder
NCforThis2022 · 26/01/2022 03:02

Does anyone know if the police were searching for her in the two days? I'd probably be reporting my 16 year old missing after a few hours if I didn't know where he was.

I was also taking very immature and possibly naive to be code for undiagnosed learning difficulties.

Frigginintheriggin · 26/01/2022 08:31

My heart breaks for this girl. This really could have been written about me. But way before social media.
Sex with a child of 12 is rape. He did admit that.
Im wondering whether there will be any justice for her? Im not saying he should have been locked up as a nonce.
But she's only been on the earth 13 short years. This is already her life. How fucking sad is that? I know what was going on in my life to get me to such a dark place. I really hope its not too late for her to find someone to really help her, focus on her needs and not just club her together in a care system where a majority of kids fail to thrive 😔
To the poster who says the girls parents have kicked her out.. how do you know this? I couldn't find that in any article.

SleepingStandingUp · 26/01/2022 08:42

@Frigginintheriggin I'm sorry X. Re licking her out, some people seem to have got confused between the two. HE got kicked out of home and lived in his car, not her

Dixiechickonhols · 26/01/2022 09:26

NCforthis it doesn’t say. The report reads as though her mum found them after they had been together 3 days and then police involved. But yes she was 12 and away from home for 3 days. No mention of school reporting her missing either.
Hopefully the case will have triggered some intervention for the girl.

GloriaSicTransitMundi · 26/01/2022 16:20

Omicrone
So he thought she was 20 then, not 16? He honestly believed that a 12 year old was actually 20, even after spending time with her in real life?

He is either very dim and extremely immature, or must have had suspicions that she wasn't being truthful about her age but decided to ignore them.

We're not talking about a 15 year old, it's a twelve year old, it's barely out of primary school. How can anyone get that confused with a 20 year old?^

I mean, the judge has ruled on this and they have all the evidence, but I just don't get it.

He is either very dim and extremely immature This could be applied to several people responding to this thread - please read it properly, even the prosecution accepted he was immature for his age and genuinely thought she was the 20 she claimed to be. He was 19 at the time. Tinder is an adult site for adults, he had no reason to suspect otherwise during the two months they chatted online, and when he did meet her in person, her appearance plus his immaturity meant he didn't realise she was seriously underage.

I feel sorry for both of them, I hope one day he'll be able to get this removed from his record.

BellatricksStrange · 26/01/2022 17:01

This thread is a good example of claiming offence by being very selective with the details and doing a clickbaity headline.

KeepingAnOpenMind · 27/01/2022 18:33

In some cultures this is perfectly acceptable though.
In Afghanistan fathers are selling off their 12 year old daughters for ‘marriage’. Yet if you complain about it it’s racist.
