Ffs my dd just had friend's license confiscated!

17 yr dd (18 next month) went out with a couple of friends tonight. In the 2nd bar she was asked for id and handed over a friend's provisional. The real document but it's not hers. Anyway it was taken off her and the bar man refused to give it back. Even after speaking to his supervisor. Dd left but now has no Id anymore and her friend has lost her actual license. I appreciate they have both committed an offence in doing this but how does she get it back?! I tried to warn her of the dangers of doing this but she's done it several times before and of course she knows best!

She never had ID in the first place. It wasn't her ID. She is underage and therefore not eligible for 18+ ID.

The venue were correct to take the ID away. It was being used falsely. The ID didn't belong to the person using it. As far as they are concerned your Dd could have taken the licence without consent.

The friend may be able to retrieve it otherwise they will need to report it lost or stolen and order a new one. Maybe your daughter should offer to pay for the replacement.

Dd needs to tell friend. Probably they'll hatch some sort of cunning scheme between them, involving a tall story and asking for it back.

Yes I meant has no 'fake' id anymore! I agree she's has her comeuppance but I feel for her as she's the only 1 not quite 18 yet. She hasn't dare tell the friend yet. Probably paying or going halves on a new one maybe the answer. God in a few weeks it won't be an issue but it did make me wonder are they allowed to keep it? What if it was actually hers? Dd and friend do look very similar hence why she's got away with it before.
No, your DD needs to pay full for it. They're like £20. Lesson learnt

He probably considered it as a potentially stolen item. If so inclined the OPs Dd and her friend can attempt to report the staff member in order to have it returned. In doing so they may well find themselves also having to take responsibility for using fake Id, assuming a false identity albeit briefly, trying to purchase alcohol underage or for so one else underage, etc.

I doubt they would want to go that route tbh.

Better to realise the OPs Dd and friend made an error of judgement, to pay for a replacement and not try to use fake if again.

Aw my god my little sister did this a couple of years ago with mine! Id just turned 18 as well Hmm
I had to phone the place up and ask if I could go and collect it as my "sister's friend" had took it, they let me but I had to show my passport to prove it was me

Tell your DD to tell her mate, if they don't let her mate come grab it then worst case scenario your DD is £20 out of pocket for the new one x

OP is probably in the USA so not sure how things work there but maybe door staff have to confiscate fraudulently used IDs to prevent them being used again.
She isn't... drinking age is 21 in US so her 18yo friends ID would be useless.

However, it's still the DD's fault for having it removed. It's still an offence even if nothing actually happens. Everyone who uses fake Id knows there's always the risk of being caught out using it.

All that's happened is a natural consequence of using fake ID.

The easiest solution is friend orders a new licence and the DD pays for it, as she is the one who lost it. I suspect the DD won't be given anyone else's ID again though simply as no one wants to deal with the consequence so she may need to get a bit more creative in order to join her mates at the bars until she turns 18.

Oh FFS, sometimes till staff in the supermarket need to see my ID, even though I'm clearly over the minimum age, and many a thread here where someone has complained about this has been in favour of supermarket staff being right to ask for that or they might lose their job.

We don't know what's happened, maybe OP's DD was insistent, or rude or tried more than once, but she's lucky she didn't get reported to the police for used false ID.

Dd told friend, friend doesn't care. She's already ordered another anyway. She doesn't even want money for a replacement despite dd offering. Friend isn't living in our town at the moment. Bar man has no idea who dd is so she definitely won't go to prison over this.Grin
Worst thing for dd now is she will have to wait a few more weeks until she can legally go. Then obviously avoid that bar. She's pissed off over that but it's tough!
Most of her friend groups are older so dd is in the minority in them. She does have school friends who are younger but as soon as lockdown lifted she enjoyed going out with both older groups of friends on proper nights out. I don't blame her or mind. As long as she's home safely and not too drunk!

As I said, @Progress2019, that was pretty much my first reaction - that the OP's dd should pay it all - but in fairness to her, the other girl DID lend her the licence, knowing why her friend wanted it, so actually going halves might be fairer.

To those saying that the barman had no right to keep the licence - what else should he have done? He has found a licence being used by someone who isn't the owner, to try to buy alcohol. If he returns it to her, chances are she'll try the same thing somewhere else, and the next bar might not have such vigilant staff. If he calls the police (as one previous poster mentioned as an option), the girl could get in a lot of trouble. So, in my opinion, he did the sensible thing.

As far as I know, my older two dses were pretty law-abiding, when it came to drinking, but we did catch ds3 with a fake ID he'd bought from Spain. We confiscated it and destroyed it, and his punishment was losing something he'd paid £35 for - and a lecture from us. He didn't do it again, and he is now 22, a graduate, and has a job. He drinks, but not to excess, so I don't think his misdemeanor has blighted his life.

Interestingly he had used it, and no-one had caught him, even though it was a pretty obvious fake, so the barman in the OP's story did well to spot that the licence didn't belong to her dd.

They usually pass them onto the police. You can argue they aren’t allowed to keep it but you won’t get anywhere (who would you report them too Confused)if they are passing it onto the police they won’t give you any sympathy.

The friend will need to call and try and claim it and if she can’t your DD will need to financially helping in getting a new one

The bar will probably hand it to the police tomorrow, friend will be able to pick it up from the police station. That's what happened when my son loaned his license to a mate. He just said he dropped it in the pub when he was out. Teenagers are idiots!
This is a decent idea.

Technically they have both committed a criminal offence. Her by using a false Id and her friend by allowing her to use it. I doubt if the police will be that bothered.

I believe the current guidance is for the staff to retain the Id, record it and hand over to the police.

What they should be doing is handing it to the police as the DD has committed a crime.

OP Your DD should have been given a receipt which will tell her what to do next, it will probably involve a trip to the local cop shop, if this is a one off then a talking to may be all she gets, but theoretically she could en up with a criminal record, a fine, and prison time.

I don't think you can make that generalisation, @flippertyop - I know I never did this, nor did my husband or sister. I'm pretty sure, as I said, that two of my three dses didn't either. So it's more accurate to say that fake IDs are more common than people think, and that more people use them than you'd assume - but you can't say everyone does.

So when he becomes an alcoholic or an irresponsible alcohol abuser because you encouraged his drinking from an early age, you won't take any responsibility or won't recognise it?

MN is so weird about alcohol.

My mum started taking me out to pubs and clubs at 16/17 - she was quite young and we looked like sisters. She wanted to show me the safer places to go and preferred to know where I was.

I've not become an alcoholic yet but I guess I'm only 40 so time will tell 🤷🏼‍♀️😂

I’ve seen passports/visas being taken off people as ID (where they’re not theirs) and the owners were told that they’ve been returned to the issuing authority. The reasoning behind it was that it as ‘theft’ to use a document that doesn’t belong to you.
