Refund refused: right or not?

So this lot arrived from TK Maxx, splintered. I ask for my money back, pointing out that the other stuff in the order was fine.

TK lose the original email with all the pix, I resend the pic I've got left, see below.

Ask timidly again - TK say 'we need more evidence', want pictures 'to show damage' 'for our auditors'.

YABU = how dare you suggest these plates are faulty you greedy cow
YANBU = at 90p each, please refund this Mumsnetter.

You must have better eyesight than me then, because even in the amended photo it’s not clear how many were broken or even if it was the original plates.

we had tickets for two upcoming shows at our local theatre which are now of course not happening but we now believe that the theatre is closing permanently and that we probably wouldnt get our money back, could this be right, they say they have no assets

Got a smashed delivery from Asda homewear. The phone line is busy, is the only message I got twice in two half hour calls. There is no online complaints e mail to send pictures to.
The packaging was so inadequate - only paper wrapped round pottery in a box at least 50 times its size! Seriously.
I can't send it back as packaging is inadequate and it's dangerous being smashed pottery with jagged edges!

I've never er bought from a Asda before - it's not a local store for us - and never will again.
Only a half wit could have packaged fragile goods in paper alone.

Is this a reverse or something? Because a tech clear out and deleting all evidence sounds like the sort of crap I get from customers being CF.
I work with returns and I would also have asked for clearer photos, you can't see anything in that photo.

wow. Well, you've binned the items and all photographic evidence that they existed. I'm not sure what you're expecting now?

BTW count me in the group of people who had no idea what I was looking at until it was explained in the thread. Your photos were not good enough and the shop made that clear when they asked for follow up evidence.

I suppose this is a learning experience. Don't throw items out if you're still waiting for a refund to be processed on them.

You maybe need a better photo but it’s pretty obvious they’re smashed. I sent a similar photo to Sainsbury’s once as a couple of side plates were smashed when delivered. I only wanted them replacing. They refunded the lot!

Look, I've been bombarded with pix and emails in lockdown and my phone went so sloooow I got exasperated & binned everything. I need to be able to call an ambo fast for reasons unconnected to covid.

Well, thank you all. I shan't be buying broken plates from TK maxx again, that's a win.

That’s all irrelevant, OP Confused Why on earth would you take one photo that you know is awful and the plate can’t clearly be seen, and then bin the broken plates before even hearing from them?

You left them no choice; with no evidence they can’t help you.

The issue is the disposal of goods that you simultaneously wanted a refund on. Legally the retailer is entitled to ask you to return the items, faulty or not.

The photos being lost or deleted wouldn’t be an issue if you still had the goods.

Their website does state that they need photos which clearly show the damage so they are just following their public policy. However as the good were dirt cheap, they will probably consider writing it off.

If you receive damaged goods and want to be refunded you have to keep them (preferably with all their packaging) until the matter is resolved and expect to have to send them back with your return postage refunded. You can, of course, continue to argue with them but without the damaged goods or any clear photos it probably wont be easy. At 90p a plate and assuming you bought 8-10 I dont think I could be bothered if I had managed to remove all the evidence.

Except this one very unclear photo. OP you seem to have an excuse for everything, yet still think TK Maxx is to blame. Confused

Sent broken plates - Binned broken plates
Sent pictures - But deleted 99% of them
Sent email - But deleted the email
