Refund refused: right or not?

So this lot arrived from TK Maxx, splintered. I ask for my money back, pointing out that the other stuff in the order was fine.

TK lose the original email with all the pix, I resend the pic I've got left, see below.

Ask timidly again - TK say 'we need more evidence', want pictures 'to show damage' 'for our auditors'.

YABU = how dare you suggest these plates are faulty you greedy cow
YANBU = at 90p each, please refund this Mumsnetter.

In that case, I’d just chalk it up to experience. It’s not a huge amount and the photo is really unclear. It’s just one of those things.

If you emailed them the original plates, then you still have the photos in your email.

Also, damaged or not, if you are after a refund you should have kept the plates for the unlikely but potential.situation where they want you to send them back.

No more pix to be had - I binned the ones I had when I cleared out my phone and I've got better things to hoard than a box of broken plates.

So you’ve got better things to do than receive a refund then.

Check your email account’s sent and deleted inboxes

Check your phone’s deleted photos album

Check your cloud photo storage

I reckon if you continue to complain they will refund you, but I can see where they’re coming from as the photo is awful. I can’t really make out what it’s showing very well. I wouldn’t be surprised if they mark your account for dodgy refund claims though.

You shouldn’t have thrown it out. You should have left it in case they wanted to collect it, faulty or not if you want a refund you are required to return the item, unless the retailer explicitly asks you to dispose of it. Otherwise anyone could order a fragile item, claim it was smashed in transit, and demand a refund without returning it.

Well, there's not much that can be done then.

The onus is on you to prove that they arrived damage. You can't do that as you didn't save the photos or the e-mail.

But if you emailed them the photos they will be in your sent box, regardless of whether you deleted them off your phone. I think you’re enjoying this. 🙄

OP seems to be ignoring the point about the photos being on the sent email. I await the next update which says she no longer uses that email, or some other bullshit excuse as to why it's not possible to retrieve the photos that way. Hmm

Not sure why you think making the complaint quickly makes a difference. The fact remains they don't have your original email, you have one photo which doesn't show enough detail to make your issue clear and you have binned the plates so can't take anymore. What would you like them to do in without any evidence of the problem? Why have you not acknowledged other posters suggestion to find the original email in your sent box? That would seem to quickly and easily solve the problem.

Why on earth would you clear out your sent items? Not a clever thing to do.

A PP posted an amended picture, you could try that.

You could also download and install a data recovery app to retrieve the deleted photos.

When did all this happen? Because if I were TK Maxx I would honestly be thinking it sounds like utter bullshit that you would send an email within 1 hour of receiving the parcel and then dispose of the plates and permanently delete the email and all but 1 rubbish picture all within the space of a few days before receiving any response from the company.... Hmm

But who deletes their sent emails of an unresolved issue? Plus the photos. Don't your photos backup to any cloud system automatically (I.e. Apple photos, Google photos, Samsung)? You can find them there

Mil deletes every photo, text, messenger message and email as soon as she has read it as if it takes up physical room somewhere. She knows it doesn't. She knows there is sometimes important information in there. She then complains like fuck when she can't recall something that she needed to know about in them. I now just shrug and say, "Well stop bloody deleting them then!". Its not my problem and I won't help any more. She's ridiculous. And stubborn. She once wanted a refund from someone on eBay but wouldn't tell them any details when they asked. Her reasoning? "Because she'd told them she should have a refund and they were just scam artists trying to get out of it."

This is pretty much what the OP believes should happen. So it's entirely plausible the OP is in fact your MIL. The alternative is that 2 people think like that and that's a scary thought...

@supersimkin2 which email account do you have and when did you delete your email? You can restore deleted emails to the trash folder after it has been emptied for Microsoft email accounts if you log in through a browser. You might be able to do this with other account providers too.
