Refund refused: right or not?

So this lot arrived from TK Maxx, splintered. I ask for my money back, pointing out that the other stuff in the order was fine.

TK lose the original email with all the pix, I resend the pic I've got left, see below.

Ask timidly again - TK say 'we need more evidence', want pictures 'to show damage' 'for our auditors'.

YABU = how dare you suggest these plates are faulty you greedy cow
YANBU = at 90p each, please refund this Mumsnetter.

You have 1 photo that is completely unidentifiable.
You delete all the other photos.
You delete the sent email when the issue isn't resolved.
You throw out the damaged items.

Sorry, you don't deserve a refund.
You are asking them to just take your word for the item being broken as you haven't provided any evidence at all.

Log onto your email normally then on a computer and it will be there.

The plates were 90p. I’d just suck it up seeing that you’ve made it very difficult to just resend the email or pictures.

A semi-decent photo would have resolved this easily. I don’t blame the company for not responding positively to the photo that was sent.

They don't have to refund unless you return the damaged object. If you threw it away that's not their problem. In future don't throw it away until they have refunded you!

When I delete photos on my phones, I can still access them in a deleted file for 30 days after - both on apple and android. While I can’t understand why you’d delete all the evidence and correspondence before the issue was resolved, I also can’t understand why you can’t get the clearer photos back. TKMaxx are probably suspicious about this too.

Sorry OP I don't think a refund will be forthcoming.

You should have kept the plates- technically they will belong to TK max after they refund, even if broken, and may want them returned.
The photo you sent is not clear enough.

You have thrown your consumer rights out of the window when you binned the plates and photos.

Put it down to experience.

Well that's just daft. Dumping the goods and all evidence of the damage before getting a resolution.

I'm changing my vote to yabu. I can't imagine why anyone would do something so stupid in real life.

Your picture is very bad... couldn't make anything out. If they are damaged, consumer law states that they have to be of merchantable quality. I.e., fit for purpose. If not, by law you are entitled to a full refund.

It's clear enough they are broken. They obviously were not packed properly. They should refund you. Were the only 90p each? You are probably talking about a very small amount of money, I would not bother pursuing it if they don't refund you. I'd just take my business elsewhere.

Now I know what it is I can see it clearly. Try calling them? I had a similar situation with John Lewis, wrong paint description on their website. Sent them evidence, they said their site was right. Yes, perhaps for the 2.5k but not the 5l and I sent a screen shot? Man was quite abrupt in his email so I rang and spoke to another advisor who couldnt have been more helpful and replaced with correct item, arranging collection for the
Wrong one....which Hermes then lost. Another story. Long and short of it though is don’t give up, you’re in the right. Photo is obvious. Money back

I would send better pic and include outside of packaging. Presumably it’s been dropped. I have insurance for deliveries arriving with customers damaged so can claim on that. .

So you received some broken goods, took a shit Pic, where it’s difficult to see then threw the goods out and deleted the email you sent?

That’s just bizarre. I can see why they would not wish to refund. They will be sitting thinking who does that.
