AIBU sold a pram but she wants refund

I put an add on gumtree selling cosatto pram for £120 (happy camper giggle 2, fashionable style costing £480 when new 18months ago). I said it had some stains on it and was otherwise in great shape. Car seat carrycot and sit up section with rain cover. All cleaned apart from the stain in the foot muff and hood, but everything else like new.
A lady responded. She arranged to come with her partner.her partner turned up I showed him the pram including one of the two stains and said the sit up bit would need a clean. He looked breifly at it, he didn't say anything about the stains, just ok, he seemed friendly, gave me the money and I helped him carry it to the car where his partner was (social distancing was abided). He loaded it to the car she did not get out of the car. 30mins later I get a text asking if she could bring it back as it's faulty, two mins later I miss two phone calls and get a text saying that she is bringing it back. I miss the calls and text asking what fault, She says it's dirty and faulty because it has stains, I said I did mention the stains and I had showed her partner all but one stain. She said "we can pay you visits at 3am". I asked what she meant (as it was 4.30pm). Twenty mins later her partner turns up and starts saying give me our money back we are calling the police. I am out at the shop at this point so my partner answers.
I have no idea if they called the police.
Since then she has text me calling me swear words and says I scammed her. I am on here asking if I'm being unreasonable because there was one stain I didn't show, it's about the size of the ring of a coffe cup, inside the foot muff where a toddlers feet would go. Everything else is really in perfect condition its a brill pram and I even took the car seat cover off and cleaned everything inside there, the carrycot had only been used twice. I feel a bit bad because when I was pregnant I was very stressy, but this woman has sworn at me via text, I've sent nice replies I've offered to clean the stain myself, send her cleaning equipment to clean it, and find a replacement foot muff or take £10 off the price, a good will gesture. She says she will have to buy a different pram now as doesnt want her baby in a stained pram.
What do you think, should I offer her a full refund or something else or nothing? AIBU?

That is a good price for a cosatto, even if stained. She has no right to a refund, for an easy life i would probably give one and resell, and next time deliver it to someone's house rather than get them to collect. Or just let her phone the police, as you've done nothing wrong not sure what she thinks they'll do.

I’m surprised you’re able to do face to face buyi)g and selling via gum tree. Freecycle closed during this time .

Sounds like a scam. I’d tell them no. They paid cash on collection. Sold as seen.

I'm one of those women who never gets very big in pregnancy and sat down many wouldn't know I was pregnant so I wouldn't read to much into it. Also I think this would be a very bad time to run a scam of this nature as a lot of people simply will not consider going to someone else's house to collect a pram.
That said I think they're taking the piss. You advised there was a stain and he accepted this. They now need to put half an hour into cleaning the stain out if they're not happy with it.

Try googling Moneyclaim Online - they don't need specialist legal advice to bring a claim; they will say the seller is clearly in violation of the Sale of Goods Act which covers you even against private sellers, particularly on distance sales where the item is not as described/damaged.

She sounds an awful person to deal with. Perhaps offer it to take it back for a restocking fee.

If within 30 mins she said she doesn't want it and brings it back why don't you just give the money back?

^ this. Take it back, give it a good clean then put it back up for sale.

You say you didn't show her a fairly large coffee sized stain on the pram that you didn't mention in the advert. I think you need to refund her and you know that that's why you are offering to clean it for her.

Yes I’m curious why if the stains are so easy to remove, you didn’t clean it, and wonder if you were at the shop spending the money he’d just given you. You also ignored their calls.

Clearly it’s buyer beware, but if it’s such a brilliant pram and they contacted you thirty mins after collection, why are you refusing it back, didn’t clean the stains yourself and ignored their calls?

I would, in this order:

  • Ask her to bring it back for a full refund
  • Check it over and issue the refund if all is as it was when you sold it
  • Report them to the police for the 3am threats
  • Wait until restrictions are lifted to resell, so the buyer can check it over more thoroughly in your presence

For a quiet life, I'd suggest they bring it back - but as someone else said, inspect it thoroughly before giving their refund. I don't know the pram in question but check things like is it the same chassis. Make sure you're not alone when they come back, as they'll want to thrust the thing at you and run off with the money.

I suspect the husband didn't tell her that you tried to point out the stains so instead of being mad at him for going ahead with the purchase, she's mad at you instead. Husband escapes her wrath.

I would give her the money back I wouldn't want someone to buy something off me and be unhappy with it. Especially as she decided so soon. Give the poor lady her money back that's pretty rubbish not to

As it’s a private sale the only things she can claim are if it is not as described or you did not have title to sell it on. She would need evidence to support her claim as under the Sale of Goods Act the burden of proof would lie with her. She could try and take you to court as she has your address. The police won’t care as they will see it as a civil matter. If she is harassing you though, you could report that. However, if you don’t want the hassle, just refund her and take it back.
