Caught speeding again... 3rd time

Hello,
I am stupid. I got caught speeding on motorway which went down to 30mph for works in September. I am allowed to do driver improvement course. I have been caught by a van one month LATER. Yesterday I was on motorway again and I'm sure for a second I was driving at 33mph. I'm so ill and worried. I've been driving 18 years and never been been caught speeding.
I need my car for work, does anyone know if I could admit the third driving offence and pleas guilty but ask for a warning not the points?

Get a radar detector that will sit on your dashboard. It's good to know where the speed traps are if only because people will suddenly slow down when they spot it.

If it really was 33 in a 30 zone you'll be fine. The leeway is 10%+2.

^^ Incorrect. DH got done twice in the SAME Day for doing 35 in a 30 zone, (same camera there and back) - he did a course and paid a fine and got 3 points on his licence.

10% of 30 is 3.3 + 2 = 5. So your formula is incorrect as otherwise DH wouldn't have been ticketed.

So you’ve doing a speed awareness course instead of taking the points for the first offence, and you’ve got to take the points for the second offence?
You may or may not have committed the third offence so you may get 3 more points, making a total of 6?
You won’t lose your licence, but your insurance will be hiked up.
Are you anxious generally? This can affect your driving.

Technically the police CAN prosecute you for anything over the limit. Even 1mph.

They don’t, because the system relies on people admitting the offence and accepting a fine rather than being prosecuted. For this to work realistically they have to leave you assured of your guilt, and if they tried to prosecute people for 1mph many would challenge this saying that the equipment wasn’t accurate enough to pick up the offence, and take it to court. The police / criminal justice system can’t possibly cope with that.

I think different counties have different parameters.

So if we don’t stick to speed limits we shouldn’t be on the road? Hmm Speed alone accounts for a pathetically small amount of accidents on our roads.

And what about bikers? the safest place for us is travelling a little faster than the rest of the traffic. I could explain why but with a little thought it should be obvious. You can go on training WITH your local police who will actively reinforce and encourage this. A choice between safety and obeying a speed limit that was set in the 1960’s should be obvious to anyone except mumsnet users.

Speed limits are enforced for reasons. Both yours and others safety. If you break them you will be eventually be disqualified from driving. There is no excuse and the offences are 'absolute' - either you are speeding or not. The whole 10% + 1 is BS made up by people who try to justify speeding.

If you've been caught 3 times, accept the Endorsable Fixed Penalty Notices and have no previous points, you have now 'totted' up 9. One more offence could leave to dL Disqualification.

  1. Insurance

You premiums are going to rocket this year as you had 3 offences in less than a few months. They will probably double at least. That said - if you were Disqualified in the future, you can expect to pay even more - A LOT more.

Once you factor in margins for error, OP could've been closer to 40 than 30.

It's actually far more likely that she was doing 30, given that speedos habitually register high. I agree that it's unlikely you'll be prosecuted, OP. However, if you get caught again no, you can't ask for a warning - you had that when you had the first ticket.

Stop speeding, it's very easy to drive under the limit, and do an advanced driving course (takes a few months). That'll sort you out long term.

Err Yes. That's why you get an automatic ban if you're caught too many times and the points mount up.

Read the thread. She's been caught twice, and one was treated with an awareness course, so she has 3 points. She is worried she might have been caught again, which would give her 6 points.

Leeway

For those 'quoting' it - it doesn't exist. You can be prosecuted for going 1 mph over the speed limit. The 'likelihood' of that happening however is low.

If you are doing over 10% above the speed limit, you may not get a ticket and can be summonsed straight to court. At court you can receive anything from 3 points up to disqualification for traffic offences.

I'd love to know where you people who never speed live.

I use cruise control much of the time in my car and do my best to stick to the speed limit. However I am constantly tailgated and overtaken by impatient drivers. I'm definitely in the minority and I can see why some drivers are bullied and intimidated into going faster than they plan.

Don't get me wrong, none of us are perfect, I'm definitely guilty of occasionally creeping over the limit on a long journey, although I try very hard not to and use my cruise control on managed motorways for this reason. I've had points before and I don't want them again, thanks very much! So I'm not judging you for that, we all make mistakes. But to ask for a warning? Surely the first 2 times you were caught should have been enough of a 'warning'?

Can you remember the exact day the van may have clocked you as they only have 2 weeks as PP have said to notify you of the offence. At 33 on the other occasion you were probably OK as Speedos are usually set higher than the speed recorded

Sounds like you're not fit to drive OP, if you can't read the signs or refuse to stick within the limit.
I think they should disqualify you as you are a threat to other road users.
