To ask you who should pay....

Person A and person B out drinking after football match last Sunday.
Person A has no pocket so asks person B to put phone in their car parked next to pub.
Person B doesn't want to be seen opening car when quite drunk. Security +police close by. Could be seen as possibly going to drive....
So person B puts phone in their pocket.
Phone drops from pocket and screen now smashed to bits.
No insurance apparently - iPhone also so diy repair a no-go.
Person A says person B needs to get it fixed. Person B has no issue with this but are they a soft touch?
To you the mn jury......

Person A should pay. Phone was only in person B's possession in order to do a favour for person A and they weren't particularly negligent. It was an unfortunate accident. People who are doing favours for others shouldn't be expected to shoulder the risk of normal missteps.

Person B broke it innocently while doing a favour requested by Person A? Person A should pay every time.

Pay half each. I'm forever cracking my screen from dropping it. Costs me £40 at the shop to repair (repair guy and me on first name terms nowBlush)

B should have gone to the rear left side door to put it in the car if they were concerned about people thinking they might drive.

The new GF should be dumped.

If this is to be a longterm relationship, I'd go so far as to offer to pay half of the repair/replacement costs (whichever is cheaper) but not for it all as they are both responsible in some way shape or form for the damage.

I didn't read it properly - It might be nice if B offered to share the cost of a repair. But I still maintain it is A's responsibility - they accepted the risk of B putting it in their pocket.

Ds was quite drunk but not at the vomiting stage.
Just been informed person B has no cash til end of July due to new job /wages.
Person A is flush - for now Sad.

Depends whether person B told person A they were not putting the phone in the car. If they both knew the phone was in B’s pocket then it was there at A’s own risk.

Not sure if this helps but I had my shattered iPad Air screen repaired by a mobile technician using genuine Apple parts at half the cost of an Apple repair. So it might not be as disastrous as feared.

They both knew it was in the pocket but it had died so person A forgot about it I am told.
Person A also pushed for take away later on despite knowing they had no cash to pay.
Got too late and place was closed anyway!!
Soft shit person B is paying for trip away tomorrow also.
