Does anyone know if this is allowed. Ex doesn't work or pay maintenance. He lives in a 3 bed housing association and rents out the rooms in the house (sleeps in the living room on the sofa so rents out 3 bedroom.) This gets him enough to live without having to work. He says he is allowed to do it and he has permission from the HA but when I spoke to the Cms and explained to them what he does and asked if they could take money from that, they said it was illegal and he want actually allowed to do it so they wouldn't be able to take any money from him. I'm not sure who is right as when I was younger my mum use to have a
Lodger and rent the box room out to him and she said it was allowed, she just had to pay a small amount to the council. Anyone know?

I seriously doubt he is allowed to sublet. Give them a ring, you have all his details!!

Nope, that would be illegal sub letting. HA is making rent affordable for those who otherwise could not get a home, not turning it into a HMO.
Report him to the HA.

I worked for a HA that did indeed allow lodgers in HA properties, you certainly weren't allowed to sub-let... Lodgers were ok though.

Ring the HA and ask, we always wanted to know if someone was doing something dodgy Grin

You would have to prove that he is actually receiving rent from these people. He could just say that they are friends of his who are staying with him.
Hard to prove he's doing anything illegal I should think!

Yes, still subletting even if he stll lives there. Our neighbours sublet one bedroom and was evicted.

Might not be illegal however, I expect he is making more than the £7000 ish in rent money that is tax free though. Get him done for tax evasion.

Under the government rent a room scheme there are limits to what you can receive before you have to pay tax.

Can you evidence what he charges for the rooms? Adverts? Facebook posts etc? Hmrc would be interested if it’s above the limit (7.5k per annum). Google government rent a room.

If he is claiming benefits they may need to know the numbers.

The hardest part will be proof.

When I lived in HA I wasn't even allowed to have my dad stay with me for a few months while waiting for a chain.
I'm almost certain he would not be allowed to do this, and that he's not declaring income either. Poor you being linked to such a snake.

He pays full rent. It's his family home, his mother died before I met him and he was 21 at the time and they ha allowed the property to be signed over to him.

We're not allowed to sublet at all. That's why I laugh at all the twats who said, 'Take in a lodger' when the bedroom tax came in. A lot of HA/council tenancies don't allow subletting of any sort.

Fucks sake, no wonder there's bloody housing crisis. I want him to be kicked out so the family it was intended for can live there. How can a 21 year old be allowed to inherit a social housing tenancy? That stinks.

He's now 32 so I don't know if things have changed since then, as it was over 10 years ago that they gave him the tenancy.

Makes no difference, he should never have got the tenancy. There are families with three kids living in one room, ffs. Shop him to the HA.

That's what confuses me as I know people who have said it's allowed but Cms said it was 100% illegal.

They will not force him to downsize they can't force anyone to. I know a few single people in 3 bed houses that live alone. (Him being the only one that rents it out) most people I know are against the bedroom TAX for people living in bigger houses than they need.

Grass the fucker up. You cannot 'make financial gain' from benefits so you are given 'enough' to live on but you certainly wouldn't be allowed to sublet. Infact this property would be classed as over crowded. I'd be seriously tempted to blackmail the fuucker on threat of reporting in order to get some £ It's a special kind of cunt who doesn't pay maintenance/fiddles the books and lies in order to pay less and he sounds like the scum of the earth OP
