Posted before I finished!! There is something wrong with my phone!

I raised a complaint about a colleague, namely:

Sexual harassment (he lifted my top up)
Sexual misconduct (trying to have sex with me in work)
Bullying and intimidation (threats I would lose my job unless I did what he wanted)

An investigation was carried out, it went to a gross misconduct meeting. I was told to prepare for his dismissal etc.

Yesterday I was told he got a 6 month written warning despite 2 of the 3 being found. I feel sick and no one will tell me why. All my evidence was text message and I can’t get my head around it. I have informally resigned as I can’t work with him anymore. I just can’t get my head around it.

Thats apalling. Are you in a union. I'd say you have a strong case for constructive dismissal (based on your OP)

I’m so sorry, I’m not an he expert, so can’t really offer you any practical advice other than to contact either your union or ACAS.
As a manager I had to mediate a situation where one of my team was being harassed by a member of another team, I felt he should have been dismissed but he was barely spoken to/ warned. I fear these situations are often badly handled and only serves to reinforce how possible it is for people to get away with it.

Get a solicitor. Pay for one if you have to. You’ll easily win a sex discrimination case if they’ve accepted those actions. You’ll get a huge payout, which will see you through until you get another job. Your employers will also be taught a vital lesson. (This is coming from someone who walked from my last job (as a solicitor))

The service asked me to come forward with extra issues of sexual misconduct not involving me. I did but I will be withdrawing it. If a complaint evidenced with 300 pages of texts gets ignored I can’t see the point in doing this.

I have another job lined up and I intend to take them to a tribunal. He is so powerful that my life will be hell. I just need to know why and then I can decide.

Nothing helpful to add about your case. Just what a disgrace, a warning letter, even though your complaint was upheld Shock

Definitely take it further, complain etc. Not sure if your local MP can help with this.

Who told you to prepare for his dismissal? If it was someone in authority then I agree you would have a case for constructive dismissal.

I was told by the investigating officer and the Director of HR that this was very serious and he was fighting for his career.

The irony is they are currently trying to recruit more females. But they let this behaviour slide.

I would understand the poor sanction if nothing was found but 2 out of the 3. Not good enough.

However, I believe that if you resign because of this it is 'constructive dismissal'. Another thing to add to your claim.

This will probably put me but I’m ex police so I would feel very silly going there for them to no further action it. I just want to know why.
