You can do a subject access request for any and all correspondence held about you (including the content of the emails) and as they are a public service they have to comply within 40 days. I would stick an SAR in anyway so you can see what is held about you.

bunbunny · 16/11/2017 09:40

Good luck getting access to the folder. Will they re-enable your email if you tell them that you haven't resigned and that you need access to access your evidence folder do your job properly. They don't have to know that you are going to go sick or resign - because in the immediate here and now they are stopping you from doing your job.

Disgusting that nobody else is talking to you, particularly as you are the victim.

Stay strong and do what is best for you.

LazySusan11 · 16/11/2017 09:42

I’m so glad you have spoken out and I am really sorry you’re having to deal with this. We are all with you! No one is so powerful they cannot be brought down eventually. He has no power over you. You are incredibly brave and strong for speaking out, I hope you get the support you need.

TheFickleFingerOfFate · 16/11/2017 09:42

Absolutely - but I'd also report him to the police. Lifting your top is sexual assault.

bunbunny · 16/11/2017 09:44

Oh and it is such a shame as it sounds like you are exactly the sort of strong principled person they should be falling over themselves to keep whereas the other toddler they should be thrilled to be able to have a relatively easy way to kick him out within a defined protocol rather than jumping through hoops of warnings and things. Can't believe he has been given barely a tap on the wrist.

rollingonariver · 16/11/2017 09:45

Op this made me cry. I had something extremely similar and nothing was done either because he was friends with my manager so he was protected.
Honestly, the worst mistake I made was not reporting him to the police. They’re the ones that will hold him, and hopefully the people that are protecting him, accountable. You seem so strong so I think you can do it, do it for the all the other women that have to work with him too! After I didn’t report it he raped three other women and I found out he’d been accused of rape by five people before me Sad

TimeForSilence · 16/11/2017 09:50

Rolling - Flowers I am so sorry

Foodie - I have replied, thank you.

I will be getting all those emails and I have composed a timeline of everything that happened. I could understand if he would have been cleared but, I know I keep saying it, 2 of the 3 were found! There is no defence for what he did.

I will speak to a solicitor then the police.

Couldn’t have done this without you lot.

Whinesalot · 16/11/2017 09:59

How did they justify their decision?

grannytomine · 16/11/2017 10:04

Go to the police, this isn't something for an employer to investigate. You have been sexually assaulted and the people who deal with that are the police.

TimeForSilence · 16/11/2017 10:05

They haven’t given me any justification.

Goldenhandshake · 16/11/2017 10:07

I work in HR, please please please see a solicitor, you have a strong case for sexual discrimination and constructive dismissal.

aintnothinbutagstring · 16/11/2017 10:07

Wow, what with everything going on in the media about sexual abuse at work, the press would be all over something like this. You still have the power here OP, use it Flowers

grannytomine · 16/11/2017 10:08

I know it is a bit late now but hopefully will help someone in future, always print out e mails in this sort of situation. Ex HR here and I know what goes on and how easy it is for your e mails to be deleted, lost, access denied etc. I have drummed this into my DD and it proved useful recently.

If you contact your tech dept about this then do it by e mail not phone and keep the replies, they could be informative and useful.

MadisonAvenue · 16/11/2017 10:12

Couldn't read and not reply although I have nothing to add.

This is absolutely disgraceful. Fight with all you have OP Flowers

flimflaminurjams · 16/11/2017 10:20

Go for it OP.

He might be powerful...

but he hasn't got the support of MN like you have Flowers

TimeForSilence · 16/11/2017 10:23

And MN has been more supportive than my soon to be ex employer. Thank you so bloody much, all of you Flowers

As soon as I get out of this hospital it’s ACAS and a solicitor. Then the police.

OP posts:
Gazelda · 16/11/2017 10:23

I’m so sorry this has happened to you.

But I’m pleased you are now angry - get all your evidence together, get a solicitor, get justice.

And be proud of yourself for standing up to him.

user1495451339 · 16/11/2017 10:26

Cannot believe this!!! How terrible for you. You have done the right thing and the outcome is a disgrace. At least you have a new job lined up but I would still take it further like it sounds like you are going to. He should be locked up!

Missingstreetlife · 16/11/2017 10:29

You can still join union if you are still employed. Gd luck

LouiseCM · 16/11/2017 10:31

angelawilliams · 16/11/2017 10:34

This is disgusting, it sounds like your work has let him off with something they definitely shouldn't have. I'd contact the local police and tell them of the situation. They might not be able to do much but they might advise you take your work and the person to court. I wouldn't put up with it as he'll know he can do it again and get away with it x

gingergenius · 16/11/2017 10:35

Not much to add but wanted to offer my support. Take this all the way OP. Bloody shitty bastard.

TimeForSilence · 16/11/2017 10:36

That was my biggest worry - a light sanction would reinforce his behaviour and it has.

All I ever wanted was an apology.

OP posts:
AdoraBell · 16/11/2017 10:40

I hope you do get justice Time

Once you get access to your emails print everything immediately.

blueskyinmarch · 16/11/2017 10:46

I feel so angry on your behalf Time. You need to do everything you can to get some justice for what happened to you. If it has been a while since you were in the Police you might find they have changed a lot of their policy and procedure on sexual assault. Go and talk to them. Good luck.
