to think if you have a penis, you do not belong in a woman's prison

There is to be an appeal tomorrow, at Bristol Crown Court, regarding the decision to send violent criminal Tara Hudson, who works as a transsexual prostitute (still has a penis, as 80% of transsexuals do), to male prison. Tara wants to go to a female prison.

AIBU to think that if you have a penis, you should go to male prison?

People are arguing that Tara is at risk of sexual assault, but Tara is not unique in this - lots of (non transgender) men are vulnerable, and the prison service has a responsibility to protect them.

I may be being dense here, but if Tara's clients are men, why would she be a sexual risk to female prisoners?

We don't segregate prisons on gender. We do it on sex.

Tara should go in a male prison and be in a single cell. Not fair to put a violent, biologically male person in with vulnerable women.
Also, I'm assuming it's not her first violent offence, due to her getting a prison sentence?
It must be hard for her, but prisons are segregated by sex for a reason. What someone says their gender is is not relevant in these kind of situations.
We need to be sensible here and protect women.

Very short and inaccurate answer:

Sex = biology/genitals/chromosomes etc
Gender = which sex stereotypes you feel you identify with most. Gender is very important to transexuals, feminists see it as an oppressive societal construct to be abolished.

How do we know this to be true? Some of the statements in her campaign are demonstrably lies. Again, we are talking about someone who is trying to manipulate their way into a women's prison.

The starting point for sentencing for common assault is not prison. Given that she pleaded guilty, this must have been a very serious assault, or she must have a history of violence, or both.

robinofsherwood, I broadly agree with you, but then I also think there may be many men who for various reasons are very vulnerable and shouldn't be in a violent prison where they will be subject to harassment.

Maybe the issues are vulnerable people being in prison at all, custodial sentences for minor crimes, and prisons being places of violence rather than a transgender issue per se.

Also, the problem is that if Tara is allowed into a women's prison, then presumably that will set a precedent in law? So even in Tara is a lovely gentle person, the next bloke who comes along with a similar complaint might not be. Best to keep male and female prisoners separate, for safety reasons.

I could is that relevant? No, I'm not transgender. I do know people who are (as I suspect do most people without realising). I'm just a big believer in respecting human rights.

nannyogg sex relates to biology ie, chromosomes ,(male = xy chromosomes, female = xx chromosomes) , different reproductive filunctions, etc.
Gender = the state of being male or female, typically referring to social and cultural differences.

if the same situation occurred with a Trans man do you think they would want to be in a male rather than a female prison? If Jack Monroe was sentenced would they choose a male prison?

I bet not because the fear of violence comes from men and all people would feel safer amongst women regardless of gender orientation.

Women who as usual are expected to accommodate the needs of others at risk to themselves. Fuck that.

Male and female refers to biological sex. Not to gender.

Gender is the set of beliefs (usually culturally and socially determined) about what a man looks/behaves like, what a woman looks/behaves like, what masculinity is, what femininity is.

Feminists believe gender to be an oppressive construct rooted in women's reproductive capabilities.

Transgender to me means:

Keeping this simple, so I will choose a person being born as a girl.

A boy being born looking like a girl, they truly believe they are born in the wrong body and are sexually attracted to boys.
