There is to be an appeal tomorrow, at Bristol Crown Court, regarding the decision to send violent criminal Tara Hudson, who works as a transsexual prostitute (still has a penis, as 80% of transsexuals do), to male prison. Tara wants to go to a female prison.

AIBU to think that if you have a penis, you should go to male prison?

People are arguing that Tara is at risk of sexual assault, but Tara is not unique in this - lots of (non transgender) men are vulnerable, and the prison service has a responsibility to protect them.

You are free to behave and dress as you like but in the eye of the law you should be a man.

If you lack a penis you are a woman, who is equally free to dress and behave how you want to.

How is the fact that she's a sex worker in any way relevant?

It's a tricky one, because she is at risk in a male prison. However, if she is male-bodied then I understand concern with her going to a female prison.

I think actually this case raises bigger questions - should she really be sent to prison? Would counselling/alcohol treatment be better? Are prisons fit for purpose if they can't keep inmates safe from physical or sexual assault?

If there is a fully functioning penis then tara is a fully functioning man then should be in a male prison its obvious to me.

If this person wants to look like a woman but still sexually operates as a man then they should go to a male prison.

Oh I can see the sensitive side of mumsnet can't tolerate the thought of women seeking out pregnancy whilst incarcerated ( welcome to the dark side of prison life, most prison officers will know about the bartering system and the general fucked up ness of being inside)

It's a 12 week sentence max not life inprisonment. I'm sure she'll survive

I googled the person's name ('Tara Hudson') and, to my surprise, couldn't find anything.

So i went back to the Daily Mail report, where I saw the images were credited to 'Instagram' and 'Twitter'.

With this clue, I found this twitter account:

Correct, attheendoftheday. Having a penis is how sex is defined. Having a penis is a male characteristic. Males do not belong in female prisons.

So all men faced with going to court and getting convicted can now declare they ' are a woman' confidant in the knowledge that they can go to a women's prison?!

Women dont get lesser sentences because they have babies so you think tara is just going to impregnate a few women so they can have babies to lesser their sentence and get on in life that is nuts.

Depending on what stage of transition she is in its likely that her penis is far from "fully functioning". The legal issue is that Tara doesn't have a gender recognition certificate & that is why legally she is still considered male. The prison where I work has had more than one transgendered inmate, we've had them pre & post op & it's likely that Tara will be accommodated in a single cell. Perhaps if she was so concerned for how vulnerable she would be in a prison environment she shouldn't have assaulted someone & as with all determinate sentences she'll only actually serve half of the 12 week sentence in custody.

People with penises should not be incarcerated with people who do not, hence why we do not have mixed sex prisons. It has nothing to do with how people identify.

I am continually horrified by how acceptable anti-trans beliefs still are. How hard is it to accept that an individual is the best expert in what their gender is, and that this is not a choice?
