neighbor refuses to give me my parcel!

hi, pls can any1 help with this problem? i placed an order with sportsdirect online, my parcel was left and signed for by a neighbor who refuses to acknowledge she has my parcel and wont speak to me! contacted sportsdirect (who dont advertise any contact numbers for customers, now i know why!) who basicaly said its not their problem that the neighbor wont return it? The courier firm (Yodel) that delivered the parcel have refered me back to sportsdirect so they wont take responsibility either! Do i just accept that Ive lost out or is there anything i could do about this???? :(

I would also be suspicious of Yodel if your neighbour says she has not got it. I had two parcels 'dissappear' which were being delivered by Yodel in the space of a week (one from sports direct and one from Gap). Both stated 'out for delivery' on the tracking for a few days then vanished.

Sports Direct were actually okay with me, I spoke to a lady in customer services who arranged for another parcel to be sent but this time royal mail recorded delivery.

Gap were unable to use a different method of postage, but as most of the items I had originally ordered were out of stock I was only ordering a couple of things so I tried again and yodel did deliver, however they delivered to my dog walker who was conveniently at my house at the right time, but the driver must have still signed with my name as it was my name down as the person who signed for it.

As others have said It is Sports Directs responsibility.

Thieving Yodel/neighbours are kind of irrelevant. It is the sellers responsibility to ensure the goods arrive with the buyer .

I've been following this thread, and have to admit, I've never really had a problem with Yodel. However, I'm not quite clear of one thing....Yodel say that the neighbour signed for it. But is the neighbour denying she ever had it, or is she just refusing to hand it over. Also I noticed you mentioned it was a girl who signed for it. Do you mean a girl, as in perhaps her daughter, or are you referring to the neighbour as a girl? Just thinking it's possible a daughter or someone has signed for it, taken it in, and has never told the woman you've been speaking to.

Anyway, hope you get things sorted - SD are definitely in the wrong here, and should either get another delivery to you asap, or refund every penny you paid, including any delivery charges.

There's someone on Twitter called @tompsk who has posted 2 hours ago saying he's got a parcel from Yodel that doesn't belong to him. A long shot but you never know!

Yodel is so rubbish. I avoid them but some companies do hide that they use them.

Yodel routinely leave parcels on our doorstep in full view of the road. I count myself incredibly lucky that we've not yet had any of them nicked!

I once chased a postman down the road for simply shoving a "sorry we missed you" card through my front door without knocking. Not only had he not knocked, he didn't actually have the parcel on him: he didn't feel like carrying any of the heavy items that day, so my parcel was sitting in his car boot. He refused to give me his name so I could make a complaint; kept trying to insist that he HAD knocked; claimed he wasn't allowed to give me my parcel now because I'd not got any proof it was for me; and was really bloody rude. He did, however, go & get me my parcel. Shame Royal Mail never replied to my complaint about him...

Definitely follow the advice of other posters about Trading Standards; Police; and hounding Sports Direct to fulfil their contractual obligations.

Just came across this statement in this month's Which?

"60% of people didn't know that if a parcel is left with a neighbour without your permission and they subsequently deny having it, you can ask the seller to resend the order at no extra cost to you. You can argue that the seller is in breach of contract by delivering to someone else without your consent"

That pretty much covers this case exactly Grin

Get on to Sports Direct and quote Which? at them! If they still refuse to send it to you, then tell them you are taking it to Which?, Trading Standards and to Small Claims Court, as they are in breach of contract.

God help anyone who has parcels delivered to them by Yodel. OH ordered a new mobile phone (not cheap) I came home one day to see the package tied to my door handle! Not impressed, no one signed for it and it could easily have been stolen. Quite incredible. Don't know what we would have done if someone had nicked off with it.

Aaah yodel. Back when they were still HDNL I ordered a brand new iPhone 4 (about a month after release), along with a case and screen covers. The screen covers and case were dispatched first, and "delivered". I returned home, nothing on the mat. As this is a block of flats, I went to check the post cubby. Nothing. No note, no parcel, nothing. knocked on the doors of the three other doors of my floor and the housebound lady on the ground floor who often took in parcels, nothing. Phoned phone company, explained the items were missing, could they stop the delivery of the expensive phone due the following day, I'd go pick up from the depot. They said they'd try. Following day, expensive phone delivered. Get home, nothing. Call phone company, who contacted courier who after a lot of backwards and forwardsing came to the block and took me to the flat he'd delivered to... One floor down on opposite side. I asked why courier hadn't left a note. "I thought you'd figure it out" was his response. Grrrrrrr yodel. (which my phone just tried to correct to useless!! Xmas Grin

Woah with the neighbour accusations. My husband once signed or a parcel for our neighbour and gave it to her. However, she then received another delivery and alleged that my husband had signed for that one too. She then stated that we were legally responsible for the package.

We had both been at work and would have had to master teleportation to sign for her bloody parcel. I was pretty pissed off that she automatically assumed that we were withholding the package without further investigation. I almost wish she'd reported us to the Police so that we could have proven that we were both at work.

Anyway, all I'm saying is don't jump to conclusions. It turns out that our neighbour was quite mad and this was only one of many crazy accusations made by her but I do believe that the delivery company recycled our name (or she's even more mental than I first thought-sigh).

there was something about this sort of thing on watchdog this morning. just caught the end of it but they said you speak to the company you ordered from as its their responsibility to get the parcel to you (not to your neighbour).

did you get your stuff?

Sports direct are a terrible company. DS likes their stuff so I will buy bits there but unless he has tried it on and will wear it then I wont get it. Their returns policy in store is terrible (just on the right side of legal), online I can imagine it is far worse.

Obviously you have issues with delivery company too, but SD are best to be avoided.

Hi, I am not sure how everything worked out, but I think it's a case for Consumer Rights. It is not your signature on the ticket, so you didn't have a parcel. Sport direct should sort it out with yodel and send you a new one. Give a call to consumer rights (google the contact details), I think they will be able to help. Don't give up. Good luck

Yes, legally it is SportsDirect who have to get your item to you intact. And to be able to prove that you received it. Which you haven't.

Your neighbour may be entirely innocent.

Have you gone to the police yet, or told SD that they have breached the Distance Selling Regs? I really hope you get your items back.

I take in parcels for neighbours, and would not dream of keeping something.

Haven't read all above posts but just wanted to say

a) They have NOT kept to terms and conditions as it's not been delivered to your house! So you could take them to small claims and

b) Call police also.

just a quick update.... i eventually got the couriers to go back to my neighbors door with her signature on the delivery note as proof and was shocked that she actually gave him the parcel back!!! it had been opened but nothing missing So i'm happy i've finally got my goods, no thanks to Sportsdirect who have terrible customer service and i would never shop there again!
