neighbor refuses to give me my parcel!

hi, pls can any1 help with this problem? i placed an order with sportsdirect online, my parcel was left and signed for by a neighbor who refuses to acknowledge she has my parcel and wont speak to me! contacted sportsdirect (who dont advertise any contact numbers for customers, now i know why!) who basicaly said its not their problem that the neighbor wont return it? The courier firm (Yodel) that delivered the parcel have refered me back to sportsdirect so they wont take responsibility either! Do i just accept that Ive lost out or is there anything i could do about this???? :(

This has happened to me twice - once with interflora flowers - I never got anywhere with that primarily as my friend (the person who placed the order) didn't pursue it.

Secondly, in a different house when my new phone got delivered. Phone company took it VERY seriously. I got a new phone within a few days (delivered to a different address) and they said they would prosecute.

Yodel are still at fault here for leaving parcel with a random they weren't instructed to leave it with. So please harrass Sports Direct. I hate Yodel with great venom.

Have you spoken to the neighbour and are they usually honest? and what is your instinct telling you?

I know this is besides the point but the last time I had a delivery off sportsdirect it was for a tennis racquet and some balls and they sent it a box that was as tall as my 5 year old son! No packing in it, just a huge box. You could peer in and the racquet was right at the bottom. I took photos! It made me weep with laughter

Yodel are crap they regularly fail to find my house and have left my parcels in the wrong road many times.

Yodel are SHIT and I HATE THEM. I refuse to use any company that delivers with them, which means I do a lot less online shopping now.

It's possible the neighbour doesn't have the parcel. I was told a parcel was delivered to me and signed for by me. Found it three weeks later mouldering under a pile of leaves in the front garden.

what a waste of time that was! spoke to sportsdirect who again have advised that they did send it to me and their terms & conditions do say that parcels may be left with a neighbor or a safe place so if the neighbor wont return it i have to contact the local police!!!! never again will i order from sportsdirect again! :(

Ah the neighbor definately signed for my parcel, the tracking details confirm that and has the signature of the girl who lives there, although im suprised she signed for it using her own name!
ok well i best get straight back on to them!

But it wasn't left in a safe place! Get on to police and Trading Standards.

Ask your bank if they can recall the payment. This can work if you paid by credit card.

I didn't receive a parcel from Amazon the other week. They looked into it and said my dh had signed for it - they gave dh's name. Only thing is dh is sure he didn't sign for it...

we had a postman sign for something for us once. when we complained and got proof of signature it was clear that we had not signed so item got sent out again.

i am sure they have to get the item to you, not your neighbour, so they should send it out again and then they get police involved as you havent received what you paid for, its not your fault they gave it to her.

It sounds like your neighbour is getting sick to death of being hounded over this. If she says she hasn't got it then you have to accept that. Argos supposedly delivered a parcel belonging to my neighbour to me. Now all I saw was a 'Sorry we missed you' card and no parcel. Certainly no one knocked on and asked me to sign for it. (If they had I would have pointed out they had the wrong street never mind the wrong house). I had 4-5 different people knock on asking about this twatting parcel. Was I sure I hadn't seen it? It says I signed for it so where is it? Even the neighbour herself came twice. I was pissed off that they couldn't get it into their teeny brains that it hadn't actually been delivered or that it had been delivered and then stolen. After being subjected to yet more questioning on my doorstep when all my previous attempts to help locate this parcel were being ignored I refused to open the door to them again. Did they find this bloody parcel in the end? I couldn't give a toss.

As far as Argos were concerned I'd definitely signed too. I was sick of being hounded and people were mean to me and I wasn't even a thief. I'm gonna cry now. :o

If you paid by credit card or visa debit card you can call your card issuer and have the transaction charged back due to non receipt. Call them and put the transaction into dispute.

This is ridiculous, they havent delivered it as you havent got it, they have palmed it off to your neighbour, so havent done their job. You should definately complain about them and c=report your neighbour for thief.

I had a similar situation years ago, a company delivered my parcel to the wrong address, then tried to say that I had to take it up with the royal mail as that was the courier service, and it was nothing to do with them. I don't know about this stuff so accepted that, until my DH got wind of it! He called up the company that sent out the item and in the end they sent out a replacement. I know that makes me sound a bit pathetic, but he's better at that sort of thing than me, and knows about the rules on these things!

Whether your neighbour has it or not is irrelevant. Sports Direct owe you a delivery. If your neighbour has it, it's their problem to get it back from her or chase her for the theft of it, it's nothing to do with you. Get back on to them, don't let them fob you off.

Have you considered that someone at Yodel stole it but said that the neighbour signed for it? I would ask Yodel for pod - proof of delivery. It should be a copy of your neighbour's signature.

Reason I say this is because I ordered from Heals a while a go. I never received anything but Heals said that it had been delivered. When I asked for pod, they didn't have anything and it turned out the delivery had 'lost' it - stolen more like!

Surely if you buy something from a company then you have a contract with them for them to provide the service of delivering your item? Which they have not done, regardless of if they feel they have 'safely' left it with the neighbour. Hound sports direct, they owe you your goods and they have not delivered your goods which is the service you paid for.
I have found which? Consumer helpline really good in the past, at least as they can give you the right arguments to tell sports direct and tell you your legal rights but you do have to pay a subscription for that. Otherwise you could also try posting this in the consumer action group forum or try watch dog. If your neighbour does have it, I doubt they will suddenly own up to it, so your best bet is to get sports direct to either refund you or send you the goods again.
