Daughter in hospital - full thickness burns

Title says it all really. I took dd to have her hair coloured today - and she's ended up in burns ward, with full thickness chemical burn on her forehead and a 50/50 chance of needing a skin graft. WTF??? Can't believe it.

Am in bits.

Its going to just drag on and on...

Still waiting for follow up appointment at plastics. One edge looking "sloughy", just keeping up with the moisturising.

DD's just has her prelims for her highers, did well considering she missed so much school.

I’m still following your thread OP and am in awe of your DD’s bravery, and your strength.

I’m appalled that the salon haven’t responded to the SAR. As you say, it’s sounds as though they’re hoping this will all go away if they ignore it. A quick Google suggests that your DD could be entitled to a really quite significant amount of compensation. Rightly so, as she has suffered pain and trauma, has had to go through medical treatments and will have permanent scarring. Plus the time she has had to take off school. They really owe her- and not just the money, but a huge apology, an acknowledgement of what went wrong, and an assurance that they are taking all the necessary steps to prevent it happening to someone else.

The whole solicitor thing isn't ultimately about any money she could get - I just want them to take responsibility for what they have done. Compensation won't undo what's happened. Them saying "look, we're sorry, we've investigated it and this is what happened, this is why it happened and this is what we've done to stop it happening again" would be better. But given that we're not getting that, I'll take every penny I can for dd.

I've been reading along since the beginning and have been horrified by how the salon have been dealing with this - I suspect that they don't understand the magnitude or the significance of how badly they've messed up. I hope your daughter's recovery continues, she seems like a very strong young lady. Gets it from her Mum, I guess? Flowers

Their insurance company should have acknowledged your solicitors by now. If the salon hasn't told their insurer about this incident yet (they should have reported the incident itself - regardless of whether you took legal action) then they will be in breach of their policy conditions.

This means the insurers could reserve their rights to decline taking on the claim - which means the salon might end up having to settle it themselves (which would be v costly to them!).

So, have had SAR response from Salon. Been asked by solicitor not to share. Account of what happened is pretty much what we've said. Interesting thing is that they've said salon manager walked past after 10 minutes and checked dd was OK, and she seemed to be. Then after another 10 mins say that someone noticed dd in distress. No ref to actually checking hair or scalp every 5 - 10 mins...

Also say that no patch test required for bleach? The test carried out was for toner. No strand test carried out.

No accident report included in SAR, no correspondence with insurers - but some correspondence with suppliers.

Pretty much. She said no one checked her hair, and didn't remember anyone walking past and asking if she was OK (which she thought she was after 10 mins)

I can’t believe the hairdressers have dragged this on for you in this way. If they had any values at all they should have apologised immediately and offered to settle any claim directly with your daughter.

I hope you get the largest possible settlement you can for her AND they are forced to admit guilt/liability.

It might be that they have to go through their insurers rather than a private settlement. They may not have the funds to do it themselves. So although having to go through this the settlement might be justifiably better this way albeit more stressful. An apology at the least should have been offered in the first instance rather than deflection.
I know money isn’t everything but it has happened now and perhaps a decent settlement can offer something to really spoil your daughter in light of what has happened.

Almost certainly will be insurance. But they should have made the process a lot easier than what it’s been, and acted like actual human beings. They should also have stopped advertising the service and the hairdresser responsible at least whilst undergoing investigation, which suggests they didn’t bother,

Good grief, it’s taking a while isn’t it? Thank heavens you have almost day by day photos. I hope your legal people aren’t going to be bludgeoned by how much better she looks so many months later, although if the medics say she’ll have some marks for life then they must take that into consideration.

Obviously none of us want her to be scarred for life but it's quite possible there will be some permanent damage.

My thoughts are with you.
