Both found guilty of manslaughter.

Thank goodness.

For the obstruction, as I said, there would be evidence of that and the NHS would push for prosecution

Are you talking about evidence and a conviction for the attack on her or the obstruction of the ambulances? You seem to be flitting from one thing to the other.

Well it's clear I'm not but you seem to have very little empathy for victims of domestic abuse.

The offence of obstruction gets him arrested.

I have responded to this post..

‘I don’t understand how anyone can throw a woman out of a window and not be serving a very long sentence for attempted murder, assault and grievous bodily harm. Why wasn’t he in prison after this?

I responded that there was no evidence, and you are waffling on about him obstructing the ambulance.

If you jumped out of a window should your partner be charged with attempted murder?

Given past behaviour of both partners, especially Mark Gordon and violent rape, then yes it would be questionable as to who threw her out of the window. There were neighbours who witnessed it and reported it.

How so?

You asked why he wasnt serving time for the attack on her. It has been set out to you why not

Its nothing to do with having empathy or not empathy for victims of DV, Im not answering that point because its ridiculous

When it was set out for you that there was no evidence of the attack on her you started talking about the obstruction of ambulances and the evidence for that, flitting from one thing to the other.

They did not see her literally being thrown of the window by him!!!! Maybe you should join the police since you seem to think you would be much better than the attending officers of that incident

“Gordon was jailed for 40 years, serving half of that in the US before being deported back to the UK.

When he was sentenced for both attacks, the rape victim pleaded with a judge to never let him free saying: ‘I ask you to make sure that this man does not have the opportunity to destroy any more lives.
‘Someone who is capable of doing this, a cruel calculated act at this age is not going to get better. He is only going to do more harm in society.’

He hid his appalling criminal history from Marten when they met in 2016, keeping it secret until after they had a spiritual marriage in Peru and had their first child together.

It wasn't until he assaulted two police officers in hospital after Marten gave birth under a false name that she learnt he was a violent rapist considered at 'high risk' of reoffending.

Gordon later attacked Marten when she was pregnant with their third child, throwing her out of their flat window and sending her plunging 18ft to the ground, hitting a car on the way.

As she lay screaming in agony with a shattered spleen and internal bleeding, putting her life and her unborn child at risk, Gordon didn't call an ambulance and attempted to delay paramedics alerted by concerned neighbours.

Marten would spend the next eight days in hospital recovering from surgery, but Gordon demanded she should be discharged despite doctors warning this would put her life at risk.

The domestic abuse was the catalyst for a family court judge to rule their four older children should be taken into care for their own protection from a ‘violent sex offender’ whose actions had ‘put her life and the life of their unborn child at serious risk’.

Two years before the death of Victoria, District Judge Madeleine Reardon warned: ‘It is much more likely than not that in the foreseeable future the children will be exposed to serious physical violence between their parents.”

Wtf. Her children wouldn’t have been at risk if he’d have been imprisoned. Which he should have been, for a long time, for that brutal attack. Horrendous.

Did they witness him push her or just her falling?
It may be obvious what has happened but if there is no proof and she won't accuse him the police/CPSs hands are tied. They can't arrest someone because they suspect he has done something they need tangible proof.

I know the DM is verboten on MN but for a judge to say he's never been spoken to by someone the way Marten spoke to him is a hell of a comment.

She's going to have a hell of a time in prison.

Yes, I strongly suspect her arrogance and conceit will be routinely beaten out of her. She'll be reduced to a cowering shell.

I doubt it, she'll control lots of vulnerable women in there, shes a manipulator, entitled, probably PD, she'll act the victim and want special treatment, make accusations against others if she doesnt get her way, also against officers although she 'll probably try to manipulate them too

I don’t understand how you can say if he’d been imprisoned the children wouldn’t have been at risk.

Constance M showed no ability to put her children first. The video of the two if them in a cafe, wrapped in winter coats while the tiny baby wore only a baby grow says so much about her parenting skills with baby five

The BBC reporting is heartbreaking. They do sound like a perfect storm of two very confused, damaged people who managed to find each other , latch on to each other and are now in an obsessive relationship that is all consuming and excludes everyone else, including their children.

The real tragedy of course is that little baby whose brief life was full of suffering when she should have been loved , nurtured and safe and the other four children whose start in life has been chaotic and frightening and who will probably never come to terms with how their damaged parents have in turn damaged them.

RIP Victoria, not even granted the dignity of either a birthdate or the date of her death.

Yes it sounds like a totally toxic relationship where somehow they fed on each other's disordered thinking.

And for the avoidance of doubt of course I think anyone who pushes anyone (let alone a pregnant woman) out of a not ground floor window should be in prison but I don't think it more than I think due process, innocent until proven guilty, PACE and the right to a fair trial matter.
Unless we want Life on Mars policing with people coppers think are guilty being fitted up.

I presume that she refused to cooperate, insisted to police that she "fell" and there was not enough evidence to charge him

This.

The police are damned if they do and damned if they don’t. They didn’t arrest- bad! They did arrest- too forceful, they literally cannot win.

From the Independent:
The family court judge also concluded an incident of domestic violence had taken place between the couple, but Marten insisted Gordon had been wrongly blamed for her falling from a window.
She later told detectives: “I had a fall from a window. There were no bruises on me, no signs of domestic violence, so how they came to that conclusion [was] quite phenomenal to be honest.”

A very different story to the one the neighbors told, and the injuries she allegedly suffered.
