Omg I have Been find 400 for for tipping 250 if I pay within 10 days .

This would have been during in my time of struggling badly with my house and the state it was in my bins getting over full and really struggling with everything really badly.

I know I should not have done it but I was struggling. As far as I know they are talking about a couple of bits I took to the communal bins . ( they don't belong to me house) but to the flats behinde me. I couldn't get the bits in the bin. So I left them next to the bin. They would have been bits of wood from a unit i think .

They saw the words ' fly-tipping' and immediately made assumptions based on their experiences of rubbish and mess just being dumped on the street / in gardens / etc.

What you did was somewhat different - yes, it comes under the term 'fly-tipping', because that's the term they use to issue the fine, but really it was "putting your rubbish in someone else's bin(s)"

And I don't think many posters read the tone of your posts, so just assumed that you were saying it wasn't your fault, or that you were asking how to get out of paying.

Please, please try and just ignore this thread and the unsupportive comments.
(and I know that's easier said than done!)
But you are actually a very brave, and honest person , who isn't ashamed to ask for help when she needs it. You deserve a break!x

What also upset me is the photos. I have already admitted what I did. But because my address was on a box or 2. They have taken photos of everything and some of that stuff is not even mine its nothing to do with me. And im very confused why they took a photo of my owm front garden. Also the fact that card scattered Over the floor was in that larger box so they have poured it over the floor then taken the photos it kind of feels like if I filled my kitchen bin with rubbish . Then someone comes along tips it on the floor then takes a photo saying look what you did. Then no one believes me when I say it was in the bin. Because the photos are proof I did not. Even though there are no before photos

If you're in a HA or council property then they will be forwarding those pictures to your landlord as it's probably part of the tenancy to keep the front garden clear. As much as you're trying to improve your lot OP nobody wants to live next door to a shit heap.

The only thing you can do is clear up what you can tomorrow, then ring the council on Monday and discuss it with them.

While I understand you were struggling with your mental health and I've been there. I do think you do have to face the consequences of just dumping stuff. I do think council removal is very expensive and it's unfair to people who don't have cars to go to the tip. The fine is also very high!

But the current system is what it is and if we all just dumped stuff that wouldn't fir in our bins everywhere would be a mess.

I drive, I paid for lessons, the test. I bought the car, I pay for petrol, maintenance, mot, tax, insurance etc.

I would pay the same for council collection if the items don't fit in my car. How is it unfair on non drivers?

I would wait until Monday and then see if you can give them a ring and talk it through with them? Even if they say there's nothing they can/will do, at least you've put your side of things to them and you'll will feel better for doing it!

OP, the fine will be because you dumped your stuff, not the AMOUNT of stuff in the pictures. You have been identified as a contributor to the mess and are being fined for your part.
If you were leaving rubbish outside of the bin, why not leave it outside of your own bin rather than make the effort to take it elsewhere and leave it there? That looks like you knew you were doing the wrong thing.
Not that it really matters now. It's done and you were caught out. You should absolutely be able to pay the fine off in instalments so maybe it's time to let this go, make a plan to pay it off and refocus on what else you need to do.

You say it wasn’t like that when you put it there. It may not have been but that is irrelevant, it wouldn’t have been like that at all if you hadn’t put it there. It might not have been the enforcement team who moved the rubbish to make it look like the photographs. You might not have dumped all the rubbish, but you dumped some of it and if you hadn’t dumped anything you wouldn’t have been fined. Councils can charge when waste builds up in front gardens.

If I had a car /could drive I would not have had any of the problems I have had . I could have got to the tip . For people on low incomes , no support , no car etc . I think people who drive and have no money issues can sometimes forget how hard it can be.

From a local council website:

Fly-tipping is illegally dumped rubbish ........... A fixed penalty will only generally be offered where a small quantity of waste is fly-tipped, or waste has since been cleared by the offender. In all other cases we will prosecute.

What to do if you receive a fixed penalty notice
There is no appeal process for an environmental offence. You should pay the fine within the period specified on the fixed penalty notice.

  • If you do not pay the fixed penalty in time you may be fined and prosecuted. You may also end up with a criminal record and have to pay our costs.
  • If you pay the fixed penalty in time we can't prosecute you and the fixed penalty won't result in a criminal offence.

so it doesn't look like there's any room for negotiation :(

Let's add. I had a long time of DV. I was often scared to leave the room, I couldn't even bath shower . There was other forms of dv via my daughter ex which meant we had to get moved under life in danger . This has all put me in a position of everything piling up . Oh yeah and my son tried to kill himself. Let's laugh at that to 🤣🤣🤣🤣 so funny spat out my tea

With all that's going on, I assumed that was an oversight. Or a belief that no one would check.
It wasn't your bin you left it beside 🤷‍♀️

I do think you should pay the fine but I absolutely believe you should have the option to pay it in instalments. THAT is what you should be focusing on. It is what it is but I don't believe you need the further stress of having to come up with an amount all at once. Set up a payment plan, stick to it and put it to the back of your mind

@Shamefullhouse Is it from the council? Just ring the switchboard and ask who you need to speak to about it?
If not, you should be able to tell from the email address where it's from and use google to see if you can track down a phone number?

And take a PP's advice - set up a payment plan, stick to it and put it to the back of your mind.
