my child’s just been awarded middle rate, i’m on UC and i was wondering if the disabled child element also gets back dated or if it was just the carer element and how long they usually take to add the elements to your claim, i was accepted thursday and notified on friday, any advice would be great thanks

Both get backdated but good luck in getting it I've been waiting since august and still not had it yet :(

@Alk19 wow that’s a long time, have you contacted citizens advice to see if they could do anything? and my assessment period ends on the 19th which is still about a week away, do you think they would add it by then? i declared it but they haven’t asked for evidence or anything yet is that normal and what do they ask for normally?. do most people’s backpacks take that long?

@SBParker99 I'm sure it's all dependent on who you get to be honest citizens advice won't be able to do anything as universal credit don't put a timeframe on it no evidence is needed as dla and dwp run through the same system so they'll be able to see your claims ect I told them just before my pay day so had to wait till my next one hopefully you've got it in time for this month x

Hi sorry my son is only 3 and I dont get any benifits for him only child benefit because he was born just before the cut off does anyone now will I still get the uc element?

@Princess23 I'm not 100% certain here but I thought if your child was in receipt of dla you're exempt from the benefit cap so I would assume you do. Have you tried a benefit calculator? That would tell you if you qualified. Sorry can't be more help

@Princess23 yeah I'm sure he'll still get it as it says on the UC guidelines if in receipt of DLA you can get the elements (disabled and carers) x

On 13/11/2021, you late reported a change on the claim from 06/09/2021.
Your claim has been referred to a Decision Maker regarding late reporting for Disabled Child Element and Carers Element for previous Assessment Periods.
When an outcome decision has been made you will be notified through the journal.

so would they ad the elements now just not backpay or is it up to the decision maker before i’ll start getting the elements

For those struggling to get UC to pay backdated Carers elements and Disability elements. If you have informed UC of the qualifying benefit within one month you should be backdated these elements in line with DLA, Carers Allowance.

Options to get UC to pay what you're entitled to:

A) leave a journal note requesting they pay the appropriate elements in line with Regulation 6 (16)-(26) of the Social Security (Claims and Payments) Regulations 1987.
B) if they still do not pay, request an MR of the decision not to pay
C) if they do not respond to the MR request, appeal the decision via gov.Uk. HM courts and tribunals can still accept the appeal even without the MR decision. Just explain you've requested it from UC but they haven't provided it.

Also contacting your MP for support can help in nudging UC along.

I've done all that next will be the mo after I've rung the today it went to mr weeks ago they told me 2 days nothing then they told me by 12th November then backtracked and said they didn't say that when they did x

Just submit an appeal then via gov.uk. HM courts and tribunals will inform UC of your appeal which will then trigger UC's appeal section to look at the decision and right a submission. Often at this point the decision is revised and backdated elements awarded as UC appeals section realise the initial decision is wrong.

Also get your MP involved.

@Alk19 so since they’ve seen it do you think there likely to have added the elements to my claim now? surely a decision maker can’t say no, we can’t notify them before having a decision

@SBParker99 yes they should of but don't hold your breath with them just await your statement and no they normally do backdate them I'm just having a nightmare with them unfortunately

@SBParker99 still no decision maker has made a decision since they've had it since august I've had it escalated and mandatory reconsideration applied on it and still nowhere just spoke with them the guy didn't have a clue told me I have to wait there's no one else I can speak to and only thing I can do is put a complaint in @plumpudisnice @Jneill2021

Does anyone know what day they normally put dla payments in if your accepted I put my claim in on the 17/09 when they received it phoned back up this morning after receiving a letter saying sorry it’s taking so long ….. still with a decision maker any one else from then received a payment or letter , freaking out this letter means she will get turned down also did you receive a payment before the letter

I received that letter also but it ended up turning up after I received my backdated payment @Blabbermouth93

@Blabbermouth93 they recieved mine on the 14th of September and it's still with the decision maker. Apparently claims that are with the descision maker at the moment have until the 21st to have a decision made on them, that's what the man told me on the phone this morning anyway.

And the letter you recieved doesnt mean that I dont think, i recieved one that was dated the 1st of this month and my sons claim is still with descision maker, it got passed to them on friday
