Sandie Peggie: Employment Tribunal, associated legal claims, and related matters - thread #68

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims were of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claimed to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and after a prolonged process judgment was handed down on 8 December 2025. That judgment is being appealed and an appeal hearing is expected to take place in 2027.

A second Employment Tribunal, Sandie Peggie vs Royal College of Nursing, has just been heard. The hearing started on Wednesday 23 September 2026 and ended on Thursday 1 October 2026. It is possible that a decision will be handed down before Christmas of this year.

Additional legal claims have been raised. Sandie Peggie is taking action against three senior managers who were witnesses in the first Employment Tribunal - Dr Kate Searle, Dr Maggie Currer and Esther Davidson, against Carol Potter, the chief executive of NHS Fife, for victimisation, against NHS Fife for discrimination, and against its director of people and culture David Miller for harassment. In addition, Sandie Peggie is being investigated by the Nursing and Midwifery Council over fitness to practice.

@Lacksie any opinions about Sam Hall having been exposed as prescribing PBs and hormones to children? She pretends to be male. She accused a safeguarding GP of transphobia when said GP simply flagged up Sam Halls behaviour. Do you think children should be dragged into this?

It was that or similar.

It is repeating the lines that McKinnon / Ivy and many other male people use. It is another philosophical attempt to claim something material and objective using deconstruction.

It never makes it true though.

The argument always seems to start at '(if) you accept my redefinition of language' then a whole pile of other things can be justified.

The if is often unstated with the listener expected to agree without thinking.

exactly!!! No where does DU say that a woman refused a trans doctor would be accused of being transphobic and punished.
Instead she emphasises that patients wishes should be respected regardless of their reason/ without requiring a reason, that she would absolutely not treat a person who requested a diff doctor and that patients' dignity , consent etc is of central importance.

the twisting of the testimony is really quite outrageous and thoroughly transparent.

What if the Dr in question wasn't Upton but one of the many 'completely passing TW' we supposedly interact unknowingly with everyday?
Patient requests a female Dr the passing TW turns up and treats the patient- have they got the patient's consent?
If it is oh so very hard to decipher the nebulous dog whistle that us bigots like to call sex how can a patient who asks for female medic ever know if the person treating her is actually female or not in order to say sorry can I see a different 'female' please?

KeepupKardigans · Yesterday 12:22

I have mentioned before about my experience on an operating table, briefly: I need an intimate procedure as part of surgical treatment, app. 5 medics present m/f. Male Dr leading op preemptively explains my right to same sex care for this minor procedure; polite, no coercion, precise information and choice. I’m perfectly safe I give permission. That’s how it should be done, he knew he was male and I a female patient with rights. DU on the other hand assumed as identified as female everyone else should go along with the delusion with the odd caveat of a sort of spurious choice. It’s only truly a choice if the individual has all the pertinent facts at the off.

You really haven’t considered the principals of safeguarding and consent in your defence of this doctor.

Consent does require a person to have full understanding of the sex category of the person they have given consent to and for that consent to not be impacted by power dynamics that could be considered as a coercive force.

Do you believe that a female patient can give consent that is with full knowledge and no coercion if a male doctor (who they expect to understand the difference between male and female humans and who they trust would act ethically and that they have to trust to treat them) presented themselves as being the female doctor that they requested?

It is a yes or no question. Do you believe they can give consent based on this scenario or not?

Article 1 states that all human beings "are born free and equal in dignity and rights".

The whole point of this argument is you are taking away one persons dignity in support of some else’s. My right to dignified care with appropriate support was taken away leading to an injury to protect someone else’s privacy from the male gaze 🤦🏻‍♀️

That is now being taken away from Transwomen on a massive scale as we can’t move away from the obsession that woman need to be protected from men! We don’t, we need to be protected from being physically harmed by another person or situations that arise because we don’t have support. In my opinion the quickest way we can get to a situation where everyone is treat with dignity and respect with appropriate support is to move away with the obsession of separating us by sex!

I am no different to my husband just because he has sex organs, stop thinking of this as a XY vs XX issue and think of it as a patient needs to be on appropriate ward for their clinical condition which also includes issues around gender identity.

if you are obsessed with protecting XX think about case where they identify as a man, they will also be forced to share a ward which doesn’t align with who they are.

Your overuse of the word ‘obsessive’ is obsessive. You absolutely are different from your husband at the most basic level - you are female and he is male. Denying such a basic fact of life totally diminishes any other argument you may have.

I can't find this is the contemporaneous reporting of tribunal tweets. Are you sure you aren't mistaking a discussion on this board for something DU actually said?

Can you link to any evidence DU said this?

As far as I can find the exchange went like this:

Cunningham: What about a rape survivor specifically wanting a cisgender woman?

Upton: Anyone can experience sexual violence. These needs can be accommodated, within the limitations of emergency care.
Cunningham: Would the patient have to disclose her history of sexual trauma?
Upton: No. Any patient can refuse to see a doctor. Preferences should be accommodated as far as possible without patients having to give reasons.

Cunningham: Imagine a woman attending A&E with unexplained heavy bleeding who asks for a female doctor. Would it be appropriate for Upton to be assigned to her?

Upton: It depends on the medical circumstances and urgency.

Cunningham: Imagine it is not an immediate emergency. Is she entitled to a female doctor to take her history?

Upton: If she wanted me to leave, I would and get someone else. Consent is very important, and patients’ wishes must be taken seriously.

Cunningham: So the patient has to say she’s uncomfortable with you?

Upton: “That’s how it works.” You cannot assume she would reject a trans woman. Clinicians should explain examinations, respect patients’ decisions to stop and make patients comfortable.

I think what DU said is being grossly misrepresented here.

As I've stated before, a lot of the content on these threads appears to amount to ruthless online bullying of a real , private individual who has been cleared of any wrongdoing. Why? Because they are trans. It's quite simply a disgrace.

Any doctor who claims that they have changed sex is a disgrace. If they cannot accept the most basic of biological facts then they should not have been able to practice as a doctor. Upton / Sam Hall are prime examples.

You ‘twisted the testimony’ when you apparently quoted the same exchange but put different words in NCs mouth. She did not say ‘cisgender’, Upton used that word. Very telling that is…

I wonder about the situation where a doctor who 'passes' might give advice about transition to a patient where the patient assumes that the advice is impartial. Wouldn't it be necessary for the doctor to declare that they have transitioned themselves?

So what do you mean by "claims to have changed sex"? Did DU ever say "I have changed sex!" No.

Is it the use of the word female you object to - because that is just a semantic demand about the use of the word.

Yes, any doctor who is trans is a disgrace. Likewise any teacher who is trans is a disgrace. All people with such a profound mental disorder that they think they have changed sex are unfit to work as doctors or teachers.

And you believe him do you? Despite him wanting to report a dementia patient as transphobic for referring to him as 'son'.

If he truly believed patients wishes should be respected he would never turn up at their bedside when they had requested a FEMALE HCP.

Your twisting to defend this man is really outrageous and thoroughly transparent.

He claims to be a woman - a "biological woman" no less.
He's a man claiming to be a women. He's alleging his birth sex has changed / transitioned from a man to a woman. In a court of law. 😂

No matter how much you huff and puff, that's the reality of the claims from trans identified men (and women).

@Lacksie Upton said he was a woman under oath. As he was born a man he has said he has changed sex declaring he is a woman.

Any thoughts on Sam Hall prescribing children with PBs and hormones illegally and bullying a safeguarding lead into submission? Anything?

Well… look here!

Now it is the word ‘female’ that is being dismissed as a semantic demand. When we are told that people with transgender identities know what sex they are and it is a gender identity that they refer to.

….. and that there is no negative impact on female people in using the language that a group of people with transgender identities and those who share there belief demand.

The incoherence and inconsistency continues.

Oh go away with this nonsense, it is not a semantic demand it is using the word as the fact based reality it is. The word female belongs to the female 51% of the population, it is their descriptor, it does NOT include males.

I thought woman was a gender word and female was sex word? But strangely enough despite there being 'sex words' and 'gender words' and sex and gender not being the same thing no one can give us a word that mean adult human female and only that?

Upton also claimed to be female, and in stating he would present himself as a female doctor if that was requested has claimed that word as a descriptor.
