Well theres a lot in this judgment worth further examination!

On the direct discrimination claim - Tickle brought a cross appeal on the basis that “knowledge of a person’s gender identity as (relevantly) a transgender man or transgender woman is a necessary element of establishing direct discrimination under s 5B(1) of the SDA

Wowsers! That goes against the whole European Court principle that someone is trans independent of their appearance or stage of transition.

I don’t see how the state can insist you that you must see someone as a woman if that’s not their perception.

Yes, this has been the crux. Sall has long argued she just deleted him because he was a man, nothing to do with him being trans. They’ve effectively argued that Sall figured out he was trans and excluded him on that basis.

Perhaps an audience member could ask her about her amendment to the Australian Sex Discrimination Act and in the light of Giggle vs Tickle if it’s working out as she envisaged?

Michael Foran has dissected this (see Twitter) - he thinks Sall's legal team took the wrong approach. Other commentators reckon the plan all along was to get the case to the High court. The toll on Sall must be intolerable.

More than one legally minded/qualified person has said to me that Sall needs a proper discrimination barrister as her legal team wasn’t up to it.

Absolutely. If there are no female spaces then there are no male spaces - none. When Australian gay men (and men there in general) start to realise that there might be a group of women in their loos or clubs or whatever just taking up their spaces then the penny might start to drop.

Reading a little further, the court made a comment about how it can only apply the law as it is after Gillard fucked with it and it isn't empowered to give its view on that law as it now is. So it sounds as though the judges may be saying "yeah, it's fucking insane, but you essentially removed sex based protections when you altered discrimination law and this is the result". Although that doesn't explain why they held up his cross appeal for direct discrimination and punished Sall still further (or does it?).

They may be right. It might actually take a further High Court loss and then subsequently a complete overhaul of the law to take it back to what it was originally before it becomes legal again for women to be able to congregate without men in Australia. Insane. Wasteful. Utterly absurd.

Fucking hell, I backpacked there years ago as a solo female traveller and there were lots of female only dorms in hostels, which I always went for if I could (most places automatically put lone women there). Women who backpack there now not only can't sleep and change in a female only dorm, they have to accept someone like him in there and be gaslit and coerced accepting he's a woman.

Shit, that's not great. Anticipated perhaps, but not great all the same. All power to Sall's elbow for the appeal to a higher court and hopefully the publicity in the meantime will let people see what's really happening here.

I'm no lawyer but, given the way the Sex Discrimination Act was rewritten in Australia, this is my thinking too. Would even the High Court have the power to come to a different decision, does anyone know? (Apologies if the info's already on the thread - it's long!)

An awful lot of people still don't grasp that Jason and his ilk are not being discriminated against for identifying as trans. Women with a trans identity - trans men - could still use Sall's app and can still use female spaces.

He was not excluded from Giggle because he claims a trans identity. He was excluded on the basis of his sex, because he is male. Exactly the same reason as any other male would be excluded. A woman who claims to be a man could join. It's not about trans, it's about male and female.

Until people grasp this - anf it's really not rocket science - there's going to be an impasse.

ETA: Just to be clear, it's this guy who isn't grasping stuff, not the PP!

Sexist claptrap.

The point is, they think they know. As do we all. We all know what a woman is. And they, in their head, because they know what a woman is, think you can't discriminate against them.

But actually, the law says no they fucking don't.

It's the same same duality of thinking that goes on here. We will invoke the actual meaning of biological sex, in order to make the distinction required to provide special treatment to men in dresses.

You have to have a space designated woman only, which everyone understands, and then stop understanding it just for the time it takes for the man in the dress to come in.

It's the same when they talk about homophobia, misogyny. For those concepts to hold any water, they have to have the sex based meaning.

Which these idealogues rely on completely in order to make their point, and then throw it all down the toilet to give a win to a man like that.

I have absolutely no doubt that Sal will triumph in the end.

But, like everywhere else, it takes publicity. It takes the weight of public opinion.

And yes, this absolute fucking travesty is a rung on that very ladder.
