We should remember that if the guidance is changed so it doesn't match the law, it's amenable to Judicial Review from this side also. GLP is not the only player in that game.

So, various things can/will happen with the Code of Practice in May re its laying before Parliament:

  • Phillipson loses her seat - not her problem any more

  • Phillipson retains her seat, but is reshuffled to a different role - not her problem any more

  • Phillipson retains her seat, is not reshuffled - now it's still her problem

  • Phillipson retains her seat, gets involved in (another) leadership bid - kicks problem down the road again

Phillipson can’t lose her seat until there is a GE though.

She has clearly waited until she can use purdah as an excuse to postpone laying the guidance before the May local elections happen. This means if Starmer is pushed out she still has no terf cooties on her hands as she would require union backing for a leadership bid.

A new trans activist PM like Rayner could simply decide to amend the Equality Act to make 'sex' include gender identity as the TRAs keep demanding.

EHRC have sent new guidance, apparently? Is that what this is about?

Dr Mary-Ann Stephenson, Chair of the Equality and Human Rights Commission, said:

“Progress is being made towards accurate and up-to-date guidance on the Equality Act 2010 being available to service providers, associations and those exercising public functions.

“The UK government recently provided us with a narrow set of comments on the draft Code of Practice we submitted in September. Having considered this feedback alongside consultation responses and further legal analysis, we have made adjustments where they help the Code provide legally accurate, practical guidance that is useful to duty bearers.

“These aim to strengthen duty bearers’ understanding of the law and how it applies across a range of the scenarios they encounter day-to-day. So that all service users are treated with dignity and respect, in line with the Equality Act.

“Our amended draft services Code of Practice has now been sent for the Secretary of State to approve in advance of it being laid in Parliament.”

Funny how the 'narrow set of comments' based on 11 (I think) pages of advice took long enough for a change of leadership at the EHRC.

Is it possible to FOI any of the communications between government and the EHRC?

Is this 'agreeing to meet' using words in the same way as BP and her ilk use the word 'woman' and 'single sex spaces' i.e. not in accordance with the English language used by the rest of the entire world or the dictionary.

I hope they don't get there to find that BP has unilaterally redefined 'agreeing to meet' to mean being dicked around for hours.

I sincerely doubt she would. It’s too toxic. In some ways the court hearings are saving the Government because they can say “nothing to do with us” blame the Judges for the recognition that single sex provision matters.

The whole zeitgeist is shifting across the world. The recent Finnish study has shown transition isn’t the panacea it has been made out to be. Sports have moved, the puberty blocker trial is mired in controversy and potential legal challenges. Law suits against doctors are bubbling up.

I doubt any Labour politician wants to stir this one up.

I just had a quick look at the pre election protocols for ministers and it says this

Ministers
Ministers remain in office and in charge of their departments during an election. It is customary for them to observe discretion in announcing initiatives that are new or of a long-term character in their capacity as a minister.

It's meant to stop them making announcements that may affect the election. Does the new guidance really fall into the category of a new initiative?
