The NHS are still considering whether they are willing to obey UK law and the Supreme Court. They may decide that UK courts don't have any jurisdiction over them and it will continue.

How does this policy decide where a non-binary person wearing trousers should go? Or an agender person?

Do you really think that someone whose psychological state warrants retention in a psychiatric ward would necessarily have the capacity to make that decision for themselves? And even if she did, the hospital was responsible for ensuring that this highly vulnerable woman was placed in the safest place. I’m quite sure she didn’t need to tell them she was a biological female. I imagine it was obvious. It certainly was to the rapists.

You would hope that a hospital would have her correct sex details before admission.

Apparently at least 1 member of staff had not been advised that a person identifying as trans was on the ward. And unfortunately if medical records had been altered to say the person was male, most would not have doubted the records. I'm sorry to say, but I think this is where not sticking to biology causes issues. Of course the attack was horrific and should not have happened, having said that.

• if a medical professional who needs to be extra observant in their chosen specialisation can not pick a woman out in a room of men then they need to fuck off and find another field to work in.

• each shift should do a hand off to the next one so I am not buying into the idea that the fact she was female and IDed as trans was lost in the computer says so and somehow some staff knew and some did not

It's a testament to quite how mad this fucking ideology is, that everyone is scrabbling around trying to find at least a semblance of reason for how this can happen.

And in the same vein, I absolutely cannot fucking believe that the people responsible aren't being held accountable.

Let's hope there's an investigation that we just don't know about. Yet.

That looks like the prosecuting barrister. They are not her lawyer, they act for the Crown and she would be the witness in the criminal case and not entitled to her own representation.

I am reminded of an oil company that investigated an accident. It turns out loads of people saw it was an accident waiting to happen but no one raised it as everyone assumed someone else would or that it must have been approved higher up the chain or command. They changed the culture completely and now it is a disciplinary offence not to report a safety risk if you see one (including down to the level of someone walking up stairs carrying something such that they don’t have a hand free to put on the bannister). The NHS seems to have implemented the exact opposite.

Yep the NHS is so far down the rabbit hole that they fail to warn/protect the staff member by clearly instructing them on what is required if they were told that the patient said she/he did not give permission to be touched by someone of their sex.

The staff member is open to possible criminal charges and loss of professional certification and liable to incur financial loss but faced with doing their job management opted to sign off blank paper.

The staff are instructed to lie to patients who notice the other sex in what should be single sex area and has a policy in place which enables the patient to be harrassed for noticing.

No it would not help.

And the medical staff who will take the stand will also have to use male words too.

The decision makers in the hospital will (I assume) not be required to explain the policy which resulted in her being placed on a male ward with no additional safeguarding.

It's striking that they're not accepting comments on this article though. I suppose they feared it would turn into a massive shitshow with victim-blaming comments like those on here last night and perhaps a bit of racism thrown in for good measure.

It can be that it is a blanket policy of the paper so as not to risk being held in contempt of court?

Most sexual crimes trials can have legal rules and court orders which restrict what can be reported or published. But I guess they did not want to be invited into court to explain.

You may have missed fact that when the State removes your rights and liberty they have a matching obligation to step in and take measures to ensure your safety?

Its a not such difficult a concept to grasp if you apply a limited amount of brain power to why rights and responsibilities are important.
