NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #44

nauticant · 25/07/2025 21:31

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and was expected to last 2 weeks. However, after 2 weeks it was not complete and it adjourned part-heard. It resumed on 16 July and the last day of evidence had been intended to be 28 July with 2 days of submissions from counsel meaning that the hearing was to have ended on 30 July. However, it became apparent as the hearing progressed that this schedule wouldn't be followed.

The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton gave evidence from Thursday 6 February to Wednesday 12 February.
Access to view the hearing remotely was obtainable by sending an email request to [email protected] by 5pm on Wednesday 9 July. Detailed instructions were provided here:

Anyone else thinking of Bleak House - Jarndyce vs Jarndyce?
Is it normal for employment tribunals to go on for ever?

Tallisker · 28/07/2025 10:55

I’m agog! Caught up this morning. My screen time notification this week was more than double my usual time. No wonder I’m getting nothing done!

Loving being part of these threads, wish I could either watch it live or be there in person. My jaw hinge is now so weak, it’s been dropped so often.

I used to work with a lovely Scottish lady who had what I thought was a strange accent - I now realise she’s from Fife 🤣 Bez sounds just like her.

So JR cannot count as well as not tell the difference between men and women?

She is not coming out of this well

BeLemonNow · 28/07/2025 10:55

Boooooooooooooooo to an extension come on talk quicker 😜

NHSF have already cast aspersions on NC's neutrality by bringing up her connections to Sex Matters, and had to withdraw it.

She has no role in ridding ScotGov of anything, she's a barrister defending her client.

NC doesn’t need to be neutral - she needs to support her client.

We can see JR is not neutral either.

borntobequiet · 28/07/2025 10:57

I expect the sight of senior doctors and overpaid, ineffectual pen pushers making tits of themselves when giving evidence has emboldened many who until now were frightened enough to not speak up against the nonsense.

"Would welcome recommendations, particularly anything that would work on audible as a first for 11 yr old (we have a long car journey soon)"

A good starting point for any young person would be the books featuring Tiffany Aching. This series of his starts with "The Wee Free Men" and then Hat Full of Sky, Wintersmith, I Shall Wear Midnight and The Shepherd's Crown.

Another alternative might be The Amazing Maurice and His Educated Rodents.

These are books that are specifically aimed at children.

Agree. These are a lovely first foray into Discworld. If you go beyond into the adult books, there is a smattering of swearing, and some “adult” topics discussed but my DD has been listening to the audiobooks since she was 10 - the swearing usually gets a giggle, and she knows she’s not allowed to repeat, most of the adult topics have gone a bit over her head, but have also served to prompt some useful discussions now she is getting a bit older.
she particularly enjoys the books with Death in, as well as the City Watch ones.

Justabaker · 28/07/2025 10:57

For anyone listening - it was Benidorm Party Group Chat?
Or just Benidorm Group Chat?

@MarieDeGournay She’s not defending her client - her client is the claimant not the respondent.

The problem is JRs constant interruptions.

MarieDeGournay · 28/07/2025 10:58

The 3000 pages came at 9.15
JR - 3,000 new pages, it seems unreasonable given that subs start tomorrow.

Tallisker · 28/07/2025 10:58

Bet Big Sond’s got writers’ cramp.

Faye has been one of my monthly donations for a few months now. And still is!

I would also like to put in a word for @IamSarah and Sussex Rape Survivors - the group who offered one women's group, one LGBTetc, and one men's.... and they let a trans-id male join the women's group and told the women to make him welcome. That was the case that woke me up to the fact that something, somewhere, had gone horribly wrong. I've been waiting a long time now for Sarah's discrimination case to reach court. NC is her barrister too.

@IamSarah has a court date in late September (at last!) and a crowdfunder. "Help Sarah’s Legal Challenge to Secure Female Only Rape Crisis Therapy" will get you there.

(I don't want NC to be too busy in September...!)

ickky · 28/07/2025 11:00

I expect poor Nauti is losing the will to live after hearing a possible part three, let alone the possible spin off series of RNC court case.

JR said 3000, that is why I put a question mark after it as I thought, that can't be right, I must have misheard. 😆

borntobequiet · 28/07/2025 11:00

Sad Times would be a great name for a band, rather in the spirit of Radiohead. (Sorry if someone else has thought of this wonderful notion already.)

Edited

I realised I had wrongly used the word 'defend' and hoped no one would notice.Hmm Wrong assumption amongst such alert and knowledgeable companySmile
I meant 'defending the interests of her client'

Iphone has an inbuilt screen reader - I turned it on by accident and it drove me mad as it reads everything (including everything I was doing to try to turn it off) but maybe there's some way to calm it down a bit...

I'm forever android. Maybe there's a similar thing. I will look.

Would be good to have a screen reader in different accents 😂

NC - I'm afraid there has been a change in my x plan, given that MC say that bio sex is not binary and very complicated, it's time consuming to unpick something like that

Please, please, please let the witness she wants to call be Prof Winston, or Dawkins, or Emma Hilton. Could NC do this?

Emma, Emma, Emma, Emma, Emma!

I get a bit of Sad Times in the winter. Especially if I don’t get outside much.

NoBinturongsHereMate · 28/07/2025 11:03

J - JR said 3,000 pages, you said 24 which is correct

I suppose it should come as no surprise that the side that can't count to 2 also can't count to 24.

I've lost track - did we ever find out what/how big the extra submissions at the end of last week were?

Sir Pterry's daughter (who is a fully fledged handmaiden going by her social media) has been insistent for years that her dad would have been a fully paid-up Be Kind-er and to Read The Books.

She knew him, I didn't, of course. But I did Read The Books, all of them, and a certain amount of gritty 'be who you really feel you are by all means but also reality is real' was what I took from them.

100%. Terry always seems to come across as someone very able to skewer nonsense and misinformation. Whilst at the same time tolerant of individuals living their own best lives.
