NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #43

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and was expected to last 2 weeks. However, after 2 weeks it was not complete and it adjourned part-heard. It resumed on 16 July and the last day of evidence had been intended to be 28 July with 2 days of submissions from counsel meaning that the hearing was to have ended on 30 July. However, it became apparent as the hearing progressed that this schedule wouldn't be followed.

The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton gave evidence from Thursday 6 February to Wednesday 12 February.

I'm sure it's not especially unusual for a barrister to have to change travel arrangements when hearings overum - so I was surprised when JR attempted the old "I've got a plane to catch" excuse - after all it's all going on Fife's bill anyway.

I think JR was just attempting to pressurize the panel into restricting NC cross examination time - but the judge was not impressed.

I thought the discussion about flights was for a date next week after JRs final submissions?

Sandie herself can't corroborate the stories, she can't tell the tribunal when or where these events took place or who was involved. So even if the stories are true they should be disregarded as evidence.

And tbh they're not relevant anyway. This case is about NHSF's treatment of Sandie after the CR incident.

AG was asked on the stand why she didn’t follow up and she didn’t have a credible answer. She said she was only asked to i/x Xmas and patient safety but one of the questions put to DU and which is central to his defence is that he never had issues with anyone else.

It is, therefore, incumbent on anything calling itself an i/x to investigate that claim and also SP’s claims.

They have taken DUs word for everything, tampered with witnesses/ broken confidentiality in DUs interest but couldn’t be bothered putting calls in to two hospitals to ask for any paperwork of complaints by Upton.

Given the chilling effect no one might have been willing to say it but there should have been a record of the complaint - what am I saying! It’s NHS complaints. They magically disappear up Upton’s airse.

I wouldn’t be surprised if The Herald have a wee FOI going on here.

I think you could be on to something he was making himself untouchable within NHS Fife.

I'm sure some of the 6 were scared of him too. That they danced to his tune. There must be a whole lot more stories about him.

Other nurses must have been equally wary of him. He must have been note taking on more than just Sandie.

I'm almost coming to the conclusion he has the potential to be a very dangerous man but has been nipped in the bud.

Others like him in the past would have succeeded with this strategy, and will now have been writing policy for e. g. political parties, large organisations, regulatory bodies etc for years.

True about it being hearsay but then so was the allegations about Sandie being racist and homophobic but it didn’t stop several Fife witnesses and a KC via her questions making the claims.

I suspect that Upton did create issues at other hospitals and the staff at the Vic know about them and didn’t want to be in his crosshairs.

Unless you're a teacher and these kids are sitting in class waiting for you to put down your phone, I wouldn't worry about it. If they're your own kids, it'll do them good to experience boredom and have to entertain themselves like we all had to 'in the olden days' of the 1950s/60s.

I'm a 1980s/90s mother and this was my solution to bored kids:
Put a tent up in the garden, fill it with dressing-up clothes, drinks & snacks, let them invite a couple of friends around and give them access to the garden hose and some massive water pistols... meanwhile, retreat to a recliner in the shade with a book.

My dd cured herself of boredom after I’d learned to counter ‘I’m booored…’ with a cheerful “good! You’ve got time to think of something interesting to do”. or suchlike. Obviously they have to be somewhat capable before this works.

Yes, I think a few witnesses have argued that SP must have been the instigator of the conflict because there had never been any previous problems involving Upton.

Totally agree. The only magic that can conjure up Upton’s desire to be a woman is what he says about himself, & the words & actions he can attempt to compel in others, most importantly for him from women.

A man twirling in front of his mirror telling himself he’s a woman is merely that. A man being referred to as she/her & occupying women only spaces is, in his head, validated in his desires.

Sandie committed the ultimate crime against him, popping the bubble of compliance that allowed him to live out his fantasy at work. His carefully crafted entry, as he would have seen it, into womanhood, was damaged by Sandie’s refusal to lie & play the game.

Sandie was like Toto the dog in The Wizard of Oz, pulling back the curtain to reveal a man who wasn’t who he claimed to be.

yes, she refuses to enter into the Immersive Fiction that Kathleen Stock describes.

I'm merely reporting some interesting info, which SP disclosed in the Ix and which I would have expected Fife to have followed up.

But they didn't. Wonder why?

If you aren't supposed to challenge a rule/law break at the time it's happening and directly impacting upon you, when are you supposed to do it?

Thinking about it I think Sandie actually behaved in a very considerate manner towards DU. I hadn’t realised that there were initially several other people in the changing room that evening, and Sandie, despite the fact that it was known she was uncomfortable with DU in the FCR , let them leave before she spoke to him. So she could have raised the issue with him and spoken in front of other people, but instead chose to have a private discussion which was far less potentially embarrassing for DU, though so much harder for Sandie.

re the phone business. I do wonder, though this is just my suspicious mind working overtime, whether DUs refusal to hand over the phone was because there were other “ contemporaneous” notes on there about other people, either people at the Victoria who had upset him, or people in other places who had challenged or misgendered or otherwise pricked his self esteem bubble. We will never know.

My other thought is that if I was so upset with a colleague I would probably not make notes on my phone, but would make paper and pen notes,( admittedly I am not a thrusting young person born with a phone attached to my hand but an old fashioned rights hoarding dinosaur) purely because a) the act of writing a lengthy account is bloody difficult on a phone and much more satisfactory to do on paper, and b) I would worry about losing the phone and my notes. It’s also easy enough to upload paper account to a phone should you later feel the need to do so. There are times when paper wins over pixels.
