NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #43

nauticant · 25/07/2025 15:21

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and was expected to last 2 weeks. However, after 2 weeks it was not complete and it adjourned part-heard. It resumed on 16 July and the last day of evidence had been intended to be 28 July with 2 days of submissions from counsel meaning that the hearing was to have ended on 30 July. However, it became apparent as the hearing progressed that this schedule wouldn't be followed.

The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton gave evidence from Thursday 6 February to Wednesday 12 February.

Access to view the hearing remotely was obtainable by sending an email request to [email protected] by 5pm on Wednesday 9 July. Detailed instructions were provided here:

Top notch summary!
who knew IT could be so gripping!?

Not me!, until it was heavily implied that Doctor Upton O'Goode - as a Twix user wittily rechristens him - might have been doctoring more than simply his patients.

If JR is concerned about leaving at 3pm to catch a flight there are other options such as getting a later flight, catching the train, or first morning flight out.

Is she panicking that she will be trapped in Dundee? She should have considered that before her ramblings this afternoon

I'm sure it's not especially unusual for a barrister to have to change travel arrangements when hearings overum - so I was surprised when JR attempted the old "I've got a plane to catch" excuse - after all it's all going on Fife's bill anyway.

I think JR was just attempting to pressurize the panel into restricting NC cross examination time - but the judge was not impressed.

There's a very expensive and quite slow Loganair flight from Dundee to Heathrow, which I presume is a twin prop as Dundee runway is tiny. I agree it's a poor choice, but perhaps that's just my latent Presbyterianism disapproving of the extravagance!

Worry not. Given the amount of money NHS Fife has wasted on this case, a couple of flights from Dundee to London will be a drop in the ocean.

@NotAGentleReminder First trying to let colleagues off the hook for the whole not knowing what sex they are nonsense. Second muddying the waters on whether Upton was a man or not. Naomi needs to go back to his GMC registration to confirm he is.

Not sure whether she needs to get into the dont most of these dsds show up well before age 27....

Seems to me the colleagues have been so confused by gender ideologues' appropriation of sex-specific language, of which everyone used to share a common understanding, and the NHS activist-influenced guidance to treat according to self-ID, that they genuinely don't know what to say when asked 'are you a man or a woman?' because they have been indoctrinated that these words don't mean what they used to think they meant and now if they don't describe themselves correctly, this could be offensive to people with pretend sex identities. Even when it's clear they're being asked what sex they are, since the activists have claimed 'female' and 'male' as self-declared gender identities too, and are even trying to teach doctors that there are different types of sex - chromosomal and hormonal, so taking cross-sex hormones can change one's 'hormonal sex'. Upton said something along these lines about hormones changing someone's sex in his February testimony, I think. Of course they know what sex they are, they just don't know what is the most acceptable thing to say any more because they've been indoctrinated that truthful language is offensive.

Upton's GMC registration used to say his 'gender' was male when he was registered as Theodore and now he is registered as 'Elisabeth' whose 'gender' is 'female' so that won't be much help! GMC hasn't recorded sex of doctors for years.

I certain a Scottish Tribunal Panel wouldn’t give a rats arse to a whinging London barrister worried about getting back to the important big smoke. JR did herself no favours here.

Via a video call that kept dropping out at DU s end by the sounds of it, so the IT guy didn't even have eyes on what Dr Upton was doing through all of it.

And they failed to keep a recording of the video call .... Fife are really bad at records 🙄

I am Pete the Plumber
I go in women's loos
I don't do skirts, or make-up
And no to high heeled shoes.

I was invented to help Naomi
In the springing of her trap
That men claiming to be women
Are just spouting lies and crap.

There really is no difference
Between me and that there Beth
And if you think there is
You've been doing too much meth.

And having done that, and been told he didn’t want to discuss it, and to raise it with their employer she kept going.

And he could have quite simply left the changing room at that point, but oh no it is all down to the woman, as ever, to do the hard graft, always the woman who should have said something different, used a different tone, behaved differently.

Just stop with the sexist, misogynistic double standards.

And he wouldn't leave until she agreed with him on how to manage the situation. Domineering man behaviour.

All Loganair flights are very expensive. Scotland’s smaller airports all struggle to attract cheaper airlines.
Manchester to Aberdeen/inverness has had Ryanair and EasyJet over the years. Cheaper for me to fly to Europe than going home

I picked my blackcurrant bushes a couple of days ago and managed to get a haul of just under 2kg. After picking out all the leaves, stalks and insects, I made jam, sorbet and have spent today inventing a new cocktail (I'm sure it's probably already a thing but anyway) which I have named a Blackcurrant Collins.

After Joan or Mr?

ah - i thought that wasn’t running anymore. Used to go from London City. A turbo prop with 24 seats. You got a cup of tea and a walkers shortbread biscuit. No tunnocks - tut! On a windy day the turbulence was awful and on one occasion I recall looking out the side window down the runway as we came into land… then the pilot whipped it round and planted the wheels on the runway. The train is much calmer!?

Looking at the flight times for next Thursday the London bound flight leaves after 5. So looks like JR isn’t flying direct from Dundee if her flight’s at 3

Yep the NHS and Doctors could give a stuff about the money.

Personally I truly believe that the whole NHS is out of control and we need to get back to basics. The focus has to be on delivering good service to its customers and not pissing about on hobby projects. Far too many mangers and hangers on without real jobs as we have witnessed over the past week. This case has really shone a light on levels of management and competency.

Needspaceforlego · 25/07/2025 20:20

@KnottyAuty
I think you could be on to something he was making himself untouchable within NHS Fife.

I'm sure some of the 6 were scared of him too. That they danced to his tune. There must be a whole lot more stories about him.

Other nurses must have been equally wary of him. He must have been note taking on more than just Sandie.

I'm almost coming to the conclusion he has the potential to be a very dangerous man but has been nipped in the bud.

PetethePlumbersToolkit · 25/07/2025 20:29

Completely agree, @Needspaceforlego These men who claim to feel threatened because women refuse to be 'little women' any more, and so they need to take back power and be in charge of women's spaces at any cost. Women don't matter in their views, unless it's in their service. It's definitely not all trans women. I know some who just get on with living their lives quietly, and these ones who try (and usually succeed!) in trampling women give them all a bad name.
This case is probably doing as much for women's rights as recognition as the suffragette movement a hundred years ago. If not more.

Don't get excited about that. Sandie is only reporting what a friend told her - hear'say evidence. Sandie herself can't corroborate the stories, she can't tell the tribunal when or where these events took place or who was involved. So even if the stories are true they should be disregarded as evidence.

And tbh they're not relevant anyway. This case is about NHSF's treatment of Sandie after the CR incident.

Well if she's flying from Edinburgh she'd definitely be better getting the train.

Whenever I've flown Loganair the Tunnock's caramel wafer was mandatory; resistance was not an option!

SerafinasGoose · 25/07/2025 20:02

Yes, they're vicious. I once trod on a bumblebee (thankfully, she was okay - they have straight and not barbed stingers which remain in the flesh but when they sting they don't die).

But oh, MY, that sting was potent. So much so that it turned my left leg completely numb, to the point that once the numbness wore off the pain was completely gone.

I've had a wasp in my dress, though, which wasn't in the least pleasant. I don't mind bees unless they fly in my face, but I have a serious phobia about wasps. Thugs of the insect world!

That explains a lot. I've gone off and looked them up - my encounter was with a small bumble bee, which I accidentally crushed when I went to investigate what was crawling under my shirt, and that went on and on stinging. I knew it was smaller than a regular honey bee.

Im getting so many complaints from the kids

Unless you're a teacher and these kids are sitting in class waiting for you to put down your phone, I wouldn't worry about it. If they're your own kids, it'll do them good to experience boredom and have to entertain themselves like we all had to 'in the olden days' of the 1950s/60s.

I'm a 1980s/90s mother and this was my solution to bored kids:
Put a tent up in the garden, fill it with dressing-up clothes, drinks & snacks, let them invite a couple of friends around and give them access to the garden hose and some massive water pistols... meanwhile, retreat to a recliner in the shade with a book.

The sad thing is that even after this monumental shitstorm he's left in his wake, I wouldn't be convinced that he has.

Women are rapidly slapped down to size the second we step outside what's too often seen as our box. As to some men, short of murder I'm unsure what they actually have to do to be disciplined. And possibly not even then.

This radioactive movement has put women's interests back more than 50 years. And it did so with alarming speed, complicity and effectiveness. I will never forgive the vacant, slogan-chanting trans bots who supported this idiocy and threw women right under an unceasing, thundering procession of juggernauts that's only vaguely dissipating even now. That includes some of my own colleagues.

Poor Sandie.
