Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and was expected to last 2 weeks. However, after 2 weeks it was not complete and it adjourned part-heard. It resumed on 16 July and the last day of evidence will be 28 July and then there will be 2 days of submissions from counsel meaning that the hearing will end on 30 July.

The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton gave evidence from Thursday 6 February to Wednesday 12 February.
Access to view the hearing remotely was obtainable by sending an email request to [email protected] by 5pm on Wednesday 9 July. Detailed instructions were provided here:

Oh my lord, the roll call of press coverage is something to behold. Blistering sunlight, with not even the ozone layer to protect them. I have been hesitant to even hope that the tide of madness might be turning. I thought the best we were heading to was a begrudging acceptance that it was not possible to force people to believe that people can change sex. But this is different. This is the forensic dissection of where TWAW gets you in real life, and just how untenable a position it is to hold. It is not lawful, it is not equitable and it is not inclusive. Upholding this delusion requires people to take up positions of such batshittery that don't survive the light from inside the fridge, never mind the blistering floodlight that is Naomi Cunningham!

@myplace I think it's because we have draconian policies about this at work, if you are found to have expressed any view that goes against the party line of trans rights rule, it's gross misconduct and you can end up in a whole heap of trouble for even looking the wrong way. So it was much easier to be a wee ostrich and hope my other half would calm down about it all.

You might wish to consult a lawyer. Your employer cannot discipline you for holding or expressing WORIAD beliefs. Forstater settled that.

Cannot legally. As we have seen, some workplaces still do it anyway. I'm still mostly keeping my head down at work as not only is the NHS totally captured, but so is the GMC.

And the BMA and most of the Royal Colleges. I really hope this case has some effect on them all but I am not holding my breath.

Slightly off-topic but I think it would be useful if the word "transwoman" was totally binned as it has the potential to create confusion. (See comments by ONS from the last census where it obviously caused confusion among people unfamiliar with the term)

One of my family members really struggles when we chat about all this because she keeps getting confused by the terms trans woman and trans man.

Now we are free to state that they are actually trans identifying men and trans identifying women, I usually do use those terms.

My post was my tongue in cheek rebuttal of the TWAW mantra in reply to a drive by scold a few posts earlier. It was in addition to two other sentences I wrote along the lines of "x-ers gonna x", "y-ers gonna y", "trans women are always gonna be men" - but in my haste I missed the "always gonna be" bit 😂

The BMA I understand - I saved some X posts a while back if I can still find them, showed how most members of the BMA don't bother to vote in the elections for board members etc, it was a shockingly low number so they were ripe for take over by young newly qualified activists.

However the Royal Colleges are surely headed by eminent Consultants who have worked long and hard for recognition. It seems incredible that they'd just roll over and suck up this insanity.

@GrumpyUngulate I know exactly what you mean. In practice, if you go against company policy they can make your life hell, even if you've not actually broken the law of the land /case precedent.
It's like @FinallyASunnyDay and @nocoolnamesleft said, employers and a lot of unions are captured. Especially public sector. They're in the caves, aren't even aware there's a mountain to go climb!
I'm really hoping that the SC judgement is impactful, along with these 'test cases'.

Which pays for the journalists who do the work to produce it. Local newspapers have such a crucial role in shining a light on things I can’t quite get the reluctance to put a coin into the bucket to pay for it.
