NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #33

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and was expected to last 2 weeks. However, after 2 weeks it was not complete and it adjourned part-heard. It resumed on 16 July and the last day of evidence will be 28 July and then there will be 2 days of submissions from counsel meaning that the hearing will end on 30 July.

The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton gave evidence from Thursday 6 February to Wednesday 12 February.

@cascade31 It sounds like there was a reference to the email somewhere but the actual email was not included. So Naomi knew something was missing but not exactly how helpful it would be. JR tried to say Naomi was on a fishing expedition. She caught some good ones.

I think it was to do with the fact there had been an initial I/x started by ED which NHS Fife denied was an investigation and so didn’t submit documents for that period because the direction had been to documents re the investigation — v slippery but now we can see why. There were a couple of clues in the emails which is how NC clocked it.

After the letter short of action arrived they realised they needed to shift the narrative. They tried to claim that AG had been the only investigator and that ED had just been starting a process leading up to I/x.

All bollocks of course because

a) why did the suspend Peggy if no I/x
b) this is when the patient safety issues formed DU ‘formal complaint’ having not previously appeared.

So they were redirected by the judge to submit all documents. I doubt that anyone in NHS Fife legal team had seen KS email til later disclosure.

Since they didn’t immediately hang up their hats they must have spent the last few weeks prepping KS.

This case just gets more and more like a train wreck! Who knew we would be here when we were nearly finished on Friday?

And if the CEO does leave or get asked to step down, what decisions will the board then make?

We knew back in February that KS had emailed the consultant group in support of DU because knowledge of the letter’s existence prompted the failed application to have her added as a respondent. How much did we (or SP’s team) know about the letter before it was revealed in this round of discovery, its precise contents were revealed on Friday?

IIRC I think it was referred to back in the spring hearing evidence as something along the lines of "KS sent an intemperate e-mail" - but it hadn't been disclosed by Fife at that point

The transcripted relevant sections that people are now releasing from
the bundle (which now includes the investigation material) is rather condemning. I wonder if whoever authorised that statement understood that political editors and others were transcripting parts of the bundle as they were now allowed to do and wanted to get ahead of the weekend news releases?

Re: the Courier report that NHS Fife claims that their “legal representatives” signed off the press statement.

  • Rarely has my flabber been more gasted
  • Do they mean Central Legal because they can’t possibly mean JR?
  • Has the board left JR and n the position where she needs to tell the tribunal panel that she’d neither prior sight of it nor sign-off.
  • Am I alone in feeling completely at sea as to the strategy?

JR is a barrister and the first line of legal advice Is always a solicitor. They should have solicitors in their legal team. A barrister is for specialist legal advice or arguing in court. So JR would not be the lawyer they would approach about the statement.

Having said that, it would be more than advisable to at least inform the legal representative who is currently arguing this case in a tribunal that a press release about said case is being issued. It completely blindsided JR, and lawyers hate that.

Ive said this before in these threads - I work in a university and trans members of staff are openly saying they will never use the gender neutral toilets as that would out them as trans. So far the university is trying its best to ignore the issue

No criminal can rank rule here.

Not suggesting character assassination is fine but she was chosen for reason.

JR is completely fine with character assassination- drawing out witnesses to comment on SP’s alleged racist, homophobic, transphobic, Trump loving views… even if these are total heresay.

Looking up Wikipedia and press articles/media appearances is hardly intrusive in comparison

How can Sandie possibly go back to work at NHS Fife though?! The whole of the senior management seem to be against her.

It's not a case of 'how can she?' but why on earth would she want to? The other health boards that border Fife would probably line up to get a nurse of that length of service and expertise, especially one who likes working nights and likes it in A&E. I think she would have an amazing second career as a nursing lecturer with a sideline in guest lecturing to law students!
My gut feeling is that she's going to be holding her head high and going back to her job that she was doing before all this blew up, because it's about the patients and doing right by them. They should have a whole band of pipers to play her in on the first shift back.
As for her registration, I would argue long and hard with the NMC that these are exceptional circs and she should get another year to get her revalidation done.

Because however much anyone says ‘transwomen are women’ or ‘I am biological and I am not a man so therefore I am a biological woman’ or similar, it isn’t delusional, is it? I mean, I don’t think transwomen actually believe, for example, that they have a uterus? They know they are male. By ‘transwomen are women’ they mean ‘you must define the word woman so that it includes transwomen’. The ideology, as I understand it, is more about control of reality rather than actual delusion.

The Herald journalists trawl through the bundle is illuminating.

Dr Upton was less than two years into his laydee journey. In the first year he had experienced some push back and had made notes about it.

As he joined he told his line manager I will be using laydee rooms as I’m a laydee and did before.

That same month in August 2023 Sandie waits outside the room to give him some privacy as he changed. And to ensure she wasn’t being watched by a man as she changed. He starts making notes on Sandie. He was looking to be offended. He was looking for challenge. He bit off much more than he can chew.

December happened because she literally had blood pouring out her cervix and vagina through her pants and through her clothing while at work. She could either stand with more blood pouring down her legs outside the room or she could ask for privacy while changing from a man.

Any biological woman would have understood to give someone privacy as they dealt with menstrual flooding in a small space. Beth is not a biological woman. Just a man looking for trouble.

Also - Fife said Sandie was suspended for safety concerns. It was clear there were no safety concerns raised when she was first suspended so that’s just a bald faced lie.

Im at the point I might just do a full timeline on this - and then do FoIs to the Trust for a hobby. We the taxpayers are enabling this abuse and lies - as we are paying the wages of the failed leadership of that organisarion.

Oh yes the sacred rules of trans is we don't 'deadname'. We all play along with the game. We know what they are, they know what they are but we all must play the silly game. And they expect the general public to keep up the charade for their feelings. It's just lies, damn lies. It would be funny but it's really not when women's and children's safety and rights are compromised.

But surely self identified ‘cis’ people who’ve said they’re happy to share with trans people and don’t value single sex facilities will be all too happy to use the mixed sex loos too? And they’ll be useful for parents with an opposite sex kid with them so it doesn’t out you as anything other than someone who wants to use that loo.
