Nurse who challenged trans doctor for using female changing rooms is cleared

An NHS nurse has been cleared of misconduct after challenging a trans doctor who used a female changing room.

Sandie Peggie was accused of misconduct by NHS Fife after questioning the presence of Dr Beth Upton.

Margaret Gribbon, Ms Peggie’s solicitor, said in a statement: “On Tuesday July 14, the evening before the resuming of her tribunal, Sandie Peggie received confirmation from Fife health board that following a disciplinary hearing, none of the gross misconduct allegations against her were upheld.

“This follows a disciplinary hearing on June 25, which considered four gross misconduct allegations: two relating to patient care failures, one of ‘misgendering’ Dr Upton, and one relating to her encounter with Dr Upton in the workplace female-only changing room on Christmas Eve 2023.

“Sandie is relieved and delighted that this 18-month-long internal process has concluded and cleared her of all allegations.”

Well, this is good news. I suspect that the slowly whirring cogs at NHS Fife have noticed the way the wind is blowing and trimmed their sails accordingly.

In any event, it's an excellent result, not only for Sandie, but any women following her, encountering a similar situation. Let's hope that, if a future Upton does this and goes weeping performatively to HR, they go:

"Fuck this! It's a radioactive hot potato!"

"The hearing was held in accordance with the national NHS Scotland Conduct Policy and followed an investigation into matters. It considered several allegations, including regarding interactions between colleagues and patient care.
"After reviewing the evidence presented, including written submissions and witness testimony, the panel found that there was insufficient evidence to support a finding of misconduct. While no formal sanctions have been imposed, the panel concluded that a facilitated reflective practice discussion would be appropriate. [my emphasis]
"NHS Fife acknowledges that this was a complex and sensitive matter, and we are satisfied that the process has been appropriately followed and is now concluded.
We remain committed to fostering a respectful, inclusive, and safe working environment for all of our staff and patients.
"As this matter relates to an individual member of staff, NHS Fife will not be making any further comment on the outcome."

No it isn't but they will be thinking about how each word that expresses they were wrong could cost them.

It doesn't really matter about the wording.

This is what matters: none of the gross misconduct allegations against her were upheld.

I am not a lawyer, but reading what Michael Foran says in the Herald article, it seems that both NHS Fife and Dr Upton were relying heavily on the argument that Sandie Peggie had harassed Dr Upton. NHS Fife can no longer argue this, because their own internal processes have cleared her. They will have to rely on some other argument (presumably that they thought they were following the law in letting Dr U use the changing room, even though we all know they weren't).

The really tricky thing for NHS Fife is that they are funding Dr Upton's defence too, and they share a barrister. Dr Upton will probably still want to argue that Sandie Peggie harassed him - but how can he do this if his own barrister is also being forced to admit, on behalf of NHS Fife, that she didn't harass him? Good luck getting out of that one, Ms Russell.

Good. But why the fuck has it taken so long? It was clear that Upton retrospectively invented the ‘gross misconduct’ to take attention away from Sandie’s complaint that he was in the women’s changing room.

He should be sacked for that alone.

I was struck by how much younger Sandie looked stood beside her solicitor this morning as her solicitor read out the update. The process really is the punishment, you could see how much relief that public acknowledgment that she had done nothing wrong has brought.

Well that's something else I can add to my complaint to the GMC about Dr Upton.
Not only has he damaged the public perception of the medical profession, admitted under oath that he intends to assault and/or sexually assault any female patients who request same sex care (if he gains consent by deception through lieing about his sex he doesn't have valid consent and its immediately assault) and imho is unfit to practice medicine due to his inability to recognise the material differences between the male and female body whether that's due to his delusions or lack of knowledge and understanding is quite honestly irrelevant. Now we have proof that he is willing to maliciously make serious false allegations against anyone who doesn't participate in his delusions including when it is detrimental to themselves.
That man is a menace to society and needs to be struck off asap

That decision to share a barrister looked foolish on the part of NHS Fife from the start, whatever decision they came to on the internal disciplinary sharing a barrister would cause them problems.

Well done Sandie, for pure endurance in seeing this through to hopefully it's common sense conclusion.
Throw the book at Upton, his registration to practice in both sexes should be ripped up and him banished from any medical practices.
