Nurse who challenged trans doctor for using female changing rooms is cleared

An NHS nurse has been cleared of misconduct after challenging a trans doctor who used a female changing room.

Sandie Peggie was accused of misconduct by NHS Fife after questioning the presence of Dr Beth Upton.

Margaret Gribbon, Ms Peggie’s solicitor, said in a statement: “On Tuesday July 14, the evening before the resuming of her tribunal, Sandie Peggie received confirmation from Fife health board that following a disciplinary hearing, none of the gross misconduct allegations against her were upheld.

“This follows a disciplinary hearing on June 25, which considered four gross misconduct allegations: two relating to patient care failures, one of ‘misgendering’ Dr Upton, and one relating to her encounter with Dr Upton in the workplace female-only changing room on Christmas Eve 2023.

“Sandie is relieved and delighted that this 18-month-long internal process has concluded and cleared her of all allegations.”

Haven't been following this case as closely as many of you but just so as you are all aware - if the Guardian supports Labour and the Telegraph is Conservative, the Herald in recent years has been pro-SNP, at least its Sunday edition.

"NHS Fife can confirm that an internal conduct hearing has concluded in relation to a staff member in our Emergency Department, following allegations concerning conduct.
"The hearing was held in accordance with the national NHS Scotland Conduct Policy and followed an investigation into matters. It considered several allegations, including regarding interactions between colleagues and patient care.
"After reviewing the evidence presented, including written submissions and witness testimony, the panel found that there was insufficient evidence to support a finding of misconduct. While no formal sanctions have been imposed, the panel concluded that a facilitated reflective practice discussion would be appropriate. [my emphasis]
"NHS Fife acknowledges that this was a complex and sensitive matter, and we are satisfied that the process has been appropriately followed and is now concluded.
We remain committed to fostering a respectful, inclusive, and safe working environment for all of our staff and patients.
"As this matter relates to an individual member of staff, NHS Fife will not be making any further comment on the outcome."

Unbelievable! They’re still blaming Sandie!

Well obviously no sanctions are imposed when a person hasn’t done anything wrong. So why is she being told to ‘reflect’ on her practice?

Basically they’re saying “We couldn’t make the charges stick, but she still needs to change her behaviour”. Her perfectly legal behaviour, that wasn’t misconduct.

What self-serving tripe. They simply cannot admit they were, and remain, in the wrong.

They’ve been facilitating sexual harassment of women by a man, and taking action against a woman for trying to defend herself.

How is that not a criminal offence by policy-makers and management of Fife health board? These individuals should be arrested.

It’s fantastic news. The money should have been spent by NHS Fife on essential medical care not on upholding a contentious ideology.

I assume from the way that it is written that they are referring to Sandie rather than Upton, who is the one who needs some "reflective practice". If that is so then I hope she challenges this "conclusion".

What do they think she's going to say in a "facilitated reflective practice discussion"? GC views are legal, the Supreme Court judgement and the workplace rules mean she is correct to have challenged him. What do they think they will get from her?

Congratulations to Sandie, I'm happy the weight of the disciplinary has been lifted off her shoulders right before round 2 of the tribunal.

I see they put in the usual doctrine, lets hope that includes women from now on, as a health service they could start by respecting biology, and as an employer they could respect the H&S act and provide single sex spaces.

That jumped out at me as well. First thought was a facilitated reflective practice discussion…for Dr U and all of NHS Fife involved in the persecution… would be appropriate.
