What's your opinion on this case? A trans man (born female, identifies as male) is in a woman's prison for the crime of murder (of an old woman), and has committed further violent crimes whilst in prison. Are you ok with this individual being in a woman's prison?

I think I have read most of this thread, but am confused by this statement.

At which point does this policy kick in.

ie when charged (tchnically still innocent so only accused of being a rapist) or after a trial where he is found guilty of rape.

If its the latter then can see real problems.

Isla was mentioned above, worth noting she was placed in a male prison to serve time. Initially she was held in a woman's prison while on remand and in solitary only until a decision was made where to put her.

She couldn't be, as rape in Scottish law, as in English and Welsh law, can only be committed with a penis.

Well, unless she had a surgically created penis which she used to rape someone, as per the Sexual Offences (Scotland) Act 2009.

But Police Scotland have forgotten about that. Or they would treat such a person as a man anyway.
