Employers seem to be slow learners when it comes to women's rights! There’s another employment tribunal case being brought by a woman who attended and took the microphone at a Let Women Speak event in Belfast last year and has been treated very badly by her employer Belfast Film Festival as a result.

Looks like we’re going to have to keep gardening until they get the message.

disclaimer. I don’t know Sara and have no connection to BFF I’m just a woman who likes donating to causes that make a difference

looks like there would be no strong objection to the application hearing being made in public.

The judge, does, however, have a right (apparently) to privately carpet the parties, which she is doing right now. But I've been told by a clerk the application hearing will not go ahead before I've had the opportunity to be heard. There is another journalist here who will join

... me in my representation, if necessary.

A recusal application means asking the judge, a panel member or the entire bench to stand down from the trial. The tribunal grinds to a halt and must be rescheduled with a new panel. No one knows the alleged grounds for recusal outside the legal teams. We're about to find out.

Does the judge think the case should go ahead according to timeframe regardless of any findings of bias / serious conflicts of interest or other similarly serious matters that come to light? I find this a little disturbing for the supposed delivery of actual justice.

Excuse my pedantry, but it's recusal (unless that was an autocorrect).

The judge and panel members are expected to remove themselves from cases where they have a conflict of interest - like knowing a witness or claimant, or being employed by one of the parties.

All Employment Tribunals are heard by a Judge (legally qualified) and two panel members. One is usually a trade union official (employed by a union) or lay representative (elected by fellow employees and very experienced in employment issues) and a representative from industry, frequently a senior HR manager or director. This means employees have someone who understands their position and employers also have someone who understands their position.

I've reported a recusal application before. They are quite rare. This was a big one - when the Post Office tried to remove Mr Justice Fraser from the Bates v Post Office litigation.

Less disturbing if it turns out it's the judge they are going after! Then it would make sense.

If the conflict of interest is genuine and would affect the case, the judge is obliged to stop.

Actually I've remembered my DM is calling me at 1.30pm to discuss the urgent family situation from a couple of days ago.

We arranged to speak during the lunch break but of course that went to pot.

I'll post when she calls. She has a meeting at 2pm, so I'll be back by then. I'd be grateful if someone could pick it up when she calls.

I don't understand why the Judge is so angry. If it's a recusal, surely they're doing the right thing. It's not as if no-one was there for the Claimant.

Whatever it is it's clearly explosive.

Because if it is found there is a conflict, then the case has to stop immediately and be reheard from the beginning.

Also if it's a panel member, they should have recused themselves at the beginning to avoid this happening.

And it might be a waste of court time.

And it is very very rude and bad not to show up to court on time, unless you're dying.

That's the line of my thinking. Generally when people get very, very angry about things that sometimes happen as part of the legal process it tells you something... but maybe the Judge just hadn't had sufficient breakfast and was annoyed at being in court for no reason. Who knows. Hopefully we'll find out soon.

I think the judge is furious at the lack of warning and then the absence of both counsel from court (for which there is presumably a reason?) and because they are from London, she might take that as a slight on NI courts generally

This - she has shown herself to be extremely professional etc in previous cases - whatever has happened/ become apparent is obviously very serious - she knows that her not showing up will seriously piss off the judge.
