There is a presumption against short sentences for ALL offences (anything under 12 months).
If the accused does not have an extensive record, then often they do not get sent to prison

Prison is as much about rehabilitation as it is punishment.
But as I say, neither you, nor I have all the facts in this case, so it is not for us to be deciding what is an appropriate sentence.
all I am saying is that, in general terms don't think supervision is not a punishment.

I agree with what you have written and certainly think that several cases of sexual assault, including against an under 16 should warrant prison.

Especially with the sheriff's comments about him not taking it seriously.

The victim is a TiF I think. Court rules (and IPSO guidelines for that matter) are that gender is affirmed by solicitors/prosecutors/sheriffs and this is the charge:

"Bond was found guilty of indecently assaulting the boy at an address in Milnathort between July 1, 2010 - when the victim was 15 - and December 31, 2010. Bond carried out a serious sex attack on the boy while he was asleep and incapable of giving consent."

Well well well according to the BBC Scotland news (just screened) the Lord advocate in Scotland has just announced a review of the practice of using diversion of prosecution for rape and serious sexual offences. They will issue revised guidance after the review which will happen "in due course".
How about not pissing about with a review and issue blanket guidance that if your a rapist you always go to jail regardless of age (obviously only those who are above the age of criminal responsibility ie 12 in Scotland)

@DuesToTheDirt I agree however its clear that there in no hurry to sort this and that they don't give a shit about victims or you know punishing rapists, never mind sending out the message that it's wrong to rape and you will face serious consequences if you do, instead of the current one of its fine do what you want with no real consequences

I doubt that this will surprise anyone else. So it turns out that whilst the review into using diversion from prosecution (only supposed to be used for low level crime) for rape they are going to keep using it ie no suspension.

Apparently he has to go to the US to take up a football scholarship. Well with the reputation football players have both here and in the US for their lack of understanding about consent he has clearly chosen the right career. Foul and disgusting human being.

That poor girl, I can’t imagine how devastated she is, first raped, then strong and determined enough in her account to convince the prosecution to press charges ( though I know things are different in Scotland) all geared for the court case, then to have the whole thing dropped at the last minute.

It isn’t just her rapist who has violated her trust in humanity.

Time after time judges display their fundamental lack of expertise and dire need for training in these types of cases. Why isn’t it happening ffs? How many more women and girls have to be treated with such disdain?

Good. I’d hoped this would happen. He’s not going to the USA for any reason for the foreseeable, because he’s going to have to declare the visa denial, which in itself probably means he wouldn’t be eligible for ESTA.

As a previous holder of a US visa that allowed me to work there, I can say that in my opinion that the USA is actually one of the hardest countries in the world to (legally) emigrate to, and they’re very fussy indeed about who they let in. You don’t need a criminal conviction, just an arrest is enough for them to think twice.

And even as a visa holder, I had no right to expect to be admitted every time I flew out, the border officer had the last (and final) say each time. I still received the occasional grilling about why I had my visa and what I did and why should the officer let me in that day.
