Non-binary biological boy at DD's girls' school: toilets

Hello, a non-binary biological boy has started at DD's girls' school.

Are there any regulations around what toilets they need to use? I just wondered what the actual legal position on this is. Thank you.

Don't be ridiculous. People don't just change sex or cease to have a sex just because they want to be/think they are the opposite sex or think that they don't have a sex.

Schools should be standing up against this not pandering to people who think sex is an optional category and everyone should be able to choose which category they are in.

The children are not being done any favours by being told that people can change sex or that some people don't have a sex (because that's what they've decided for themselves).

OP, how old is your daughter? Is she young enough to think that a girl with very short hair is a boy, for example? Are you absolutely sure this child is male?

For building regs, check your local authority guidance.

School Premises Regulations 2012:

'ISS Regulation 23A — (1) Subject to sub-paragraph (2), the standard in this paragraph is met if the proprietor ensures that—
a) suitable toilet and washing facilities are provided for the sole use of pupils;
b) separate toilet facilities for boys and girls aged 8 years or over are provided except where the toilet facility is provided in a room that can be secured from the inside and that is intended for use by one pupil at a time; and
c) suitable changing accommodation and showers are provided for pupils aged 11 years or over at the start of the school year who receive physical education'

I dont disagree, at all. I dont agree they should be there and I can see why people arent happy.

But the child is non binary which complicates the discussion. Sticking fingers in ears going la la hes a boy doesn't change that.

If PP want to suggest they could just March up to the school and inform the head hes a boy, well, each to their own.

What he chooses to think his identity is, thats an internal subjective issue, if he chooses to believe in something called non binary thats a different matter, he can call himself non binary and be a boy. They are two separate things

Perhaps you could suggest the schools do just that. I'm sure they will. Cant see an issue with that at all.

I think I would like clarity from the school, if I were a parent, that the school is now open to both boys and girls as long as the boys state they have one of a list of specific identities at time of application. If they've done this for one boy, then they would have a hard time refusing others.

The whole sorry tale started with 'transwomen are women.' If you start with that mantra, then none of the rest of the debate can be had. Not wanting men in women's spaces can't be talked about if males can say they're women.

So, calling people what they are, literally is the answer to anything.

This boy is a boy. He does not belong in a girls school. If he would like to wear a dress and be called Susie, that's fine, doesn't harm anyone, but he is a boy and belongs in a school which takes boys.

When my children started a new school, and that was years ago, we always had to show their birth certificates. I think that was more often about proving date of birth in those days.

This NB child we are discussing here will also have a birth certificate. With a sex on it. Female or male. Girl or boy. However it was termed when the child was born (which has changed, as mine says 'girl' and my daughter's says 'female' 25 years apart, both in England) . Whichever. But not non-binary.

This child can't have a GRC. The NB child's sex remains as stated on the BC and that is what the school should take into account and only that.

Yes. For Building regs and according to school guidance, the whole toilet - including sink - needs to be enclosed when its mixed sex provision.

I was recently in a Co Ed school built within the last 2 years and cubicles were individual but sinks were outside except the disabled toilet. I wondered if this was legal but as the school is so new thought it must be.

What I never understand about situations such as this (which I’ve thankfully never come across in real life) is the thought processes of the parents of the ‘non-binary’ child. Why would you choose to send your child to a single sex school (of the opposite sex) why not a mixed sex school where they can identify as they wish but blend in better as there are facilities for both sexes. They might as well have put a big sign around a their neck saying ‘I’m different to everybody else’.
I have to admit to finding the whole gender dysphoria thing utterly baffling.

I think this whole thing is so bonkers the OPs first step has to be to verify whether the DD has the right end of the stick.

I think the non binary person is probably biologically female and the rumour mill has gone wild.

Might be wrong tho!

No one can "erode" non binary. It's an irrelevant identity label about how one sees one's personality, not a material quality. If this child identifies as a cat, it's no more or less real, and it doesn't change the fact of what a cat is.

I know a teacher in a single sex girlsstate school onsoith London. They have a trans boy i.e a girl who identifies as a boy. Perhaps they should be asked to leave and go to the boys state school, where they'd not survive for long!
