I note none of the usual TRAs have popped up to support Sally so far.

Because not even the most ardent genderist can support paedophiles in women's prisons.

If a mother living in the community decides that she wants to live with a convicted child sex offender her baby will be taken into care - safeguarding. However mothers in prison who have no choice are having child sex offenders forced on them.

Many of these imprisoned women need help with understanding healthy boundaries and that they can say a firm no in circumstances in which they feel unsafe to better protect themselves and their families on release. Surely this breach of their boundaries is absolutely counterproductive in their rehabilitation and the building of their shark cages/trusting their instincts on reg flags.

I don't think Bronzefield has a transgender wing.

When a male at Bronzefield was found having sex with one of the female inmates, said male was transferred to Downview, where there is a transgender wing.

I see the police have had to backtrack on Twitter after the crime commissioner got involved. Hopefully the profile of this sentencing now
being raised means someone is looking at the issue of this person being locked up with vulnerable women. That is how I try to reassure myself - there has to be someone with influence who will have seen this happen and is in a position to raise questions about the team who assessed this person and decided on Bronzefield, basically decided the well-being of this person was more important than the well-being of vulnerable women.

Whilst you are here @stillvicarinatutu can you just answer a question for me please?

The Police in Sussex and elsewhere seem to believe that there is a crime of misgendering, is there? In what Act was this made a crime and what is the prescribed punishment for it?

As far as I am aware and from my searching there is no such thing as a crime of misgendering on the Statute Books.

This is the thing - I would have said not because as was pointed out to me previously gender identity isn't actually a protected characteristic however - I'll just copy what the citizens advice website says :

If this is incorrect it's being bandied about with impunity.

It appears that "gender identity " has weedled it's wording into what the consensus says is a protected characteristic. !!

Policy says one thing - but does the actual law differ ?

I need to find out . Because for me - a man is a man and a woman is a woman and they can quite freely decide to live as something else but I can't understand how a FACT can be a crime or hate incident.....

But then I think in a larger scale - if someone is black and their neighbour says "get lost you black bastard " - well they might be black and indeed they might be a bastard but in the eyes of the law that's not acceptable.

So if someone says "get lost chic with a dick " how do we differentiate?

(I've had that exact actual scenario in my career )

Just out of interest what would the charge be for calling someone a 'black bastard' and how is that crime worded and what is the possible sentence/punishment for it?

I note in Sussex Police's non-apology apology they stated that people were entitled to air their views within the Law, again what law are they applying here? and that sounds very much like people can indeed call a man a man irrespective of gender identity status.

It's a right mess and urgent clear, unambiguous clarification is required - time to step up and sort this out Government and in particular Home Secretary.

This is what we are taught - ok so don't blame the messenger please!

If someone perceives that something is said or done (a crime or not) because of a protected characteristic then it's either to be logged as a hate incident or a hate crime .

HOWEVER! Since gender "identity " appears to have been an afterthought tagged on to the list of "protected characteristics " and not actually written into law I would actually query whether that particular characteristic would hold water in a court of law .

I don't think if challenged it would to be honest because it's not been written into law as far as I understand it.

And I'm going a little on what's been said here because it appears that many we'll informed women are telling me it's not - I need to actually get definitive clarity here from government.

So while it's perceived to be a characteristic- if it's not actually written into the law - then no . It's not .

However I doubt very many cops would question this to the letter of the law - which is what needs to be highlighted and clarified.

Oh and the other part of your question-
Because race IS a protected characteristic the charge for calling someone a black bastard would be a racially aggravated public order offence .

But that's very cut and dried - race is a protected characteristic.
