This is a very recent judgment, there isn't necessarily any case law yet. Read the judgment.

But the woman who had a sticker in her own home that you'd have put a non crime hate incident against, is fair game?

Here is a blog about the revised guidelines. Fair Cop don't think they have revised them sufficiently in all elements and may take further legal action.

However, the revised guidance is not the end of this story. The Police, Crime, Sentencing and Courts Act 20222^ which received Royal Assent in April 2022, included provisions to allow the Home Secretary to issue a statutory code of practice about the recording and retention of personal data relating to non-crime hate incidents. The College of Policing is currently engaged in developing this code to ensure it and the updated APP ‘fully align’. We may see the code in late 2022 or early 2023.

It may therefore be sensible to wait for this code and any further revisions of the APP which it requires and decide then if an action in judicial review is justified.

Which could appear on an enhanced DBS. For a non crime incident.

The incident with the woman who had a sticker on her door and was visited by the PCSO - this woman had already had a visit from two 'proper' Police Officers who talked to her and went away leaving her assured that there wasn't a problem with the sticker the PCSO then turns up and delivers her ranty, political lecture full of all the Stonewall soundbites. Yes I fully agree that the woman should complain about the PCSO and would have an excellent case against them, however, if she does so she will be identified and then mere cannon fodder for the TRAs, she will have to face the Police complaints procedure - no wonder she is terrified, did you not hear how upset and scared she was on that recording? The woman is unlikely to be tough enough to withstand what she would have to if she complained and that is a major problem.

On the topic of NCHIs and DBS checks, here's a Reddit thread from a while ago.

The OP claims that a NCHI was recorded against them without their knowledge, and they only found out about it because it did show up on a DBS check.

Their ''crime'' (non-crime) was being a 'Leave' supporter (Brexit), and campaigning using materials that were approved by the Electoral Commission. The ''victim'' decided the OP was 'motivated by dislike of minority racial groups'.

The charity the OP was applying to volunteer for turned down their application because of the NCHI.
