Just to add that I too am so impressed by Maya and how she is handled this and for setting up Sex Matters. She is a true inspiration and whatever happens tomorrow she has made a huge and positive difference.

She has already won in my eyes. She started the public conversation which has lead to others being able to speak out. Things have changed dramatically.

If she loses, it will be on the basis that she wasn’t an employee / didn’t have employment rights.

I couldn’t see that her employment rights status was established convincingly in the tribunal evidence.

However if the tribunal do find her to have had employment rights, then I’ll be amazed if she doesn’t win.

As mentioned by a PP, Maya could lose on the technicality that she was not an employee. That shouldn’t in any way undermine the impact of the EAT ruling that GC beliefs are worth my of protection.

However, the ET also has to decide whether what Maya actually said went beyond what is acceptable and worthy of protection- the EAT made clear that GC people don’t have carte blanche to eg harass/attack trans people. Obviously if Maya loses on this front that is far more of a blow, but would not alter the point of principle that respectfully expressed GC views are protected in law.

I think it’s likely Maya and her team have had the embargoed judgment for a day or two but I don’t know for sure if that’s how it works in the ET.

I stand corrected -Maya tweeted earlier that she doesn’t know the result yet.

But the EAT ruling means she GC critical people have already won. I just hope Maya herself wins hands down tomorrow.

Technically not an employee? Now, I thought everyone was protected against discrimination in employment law at all stages of employment, so you could bring a tribunal if you felt you were discriminated against at application or interview stage if you had a strong enough case?

Mind you, from my own experience, tribunals and employment law are all but impenetrable to a large proportion of the population.....

You can. I think this rests on something like whether they had reciprocal obligations making the relationship like enough to an employment relationship to make discrimination protection kick in. I don’t really know where the bar to that is. It can’t be that high otherwise she would have been advised that her case had no chance of succeeding, but the other side certainly argued with some vigour that she wasn’t an employee in the way that she said she was.

Yes the definition of who is covered by discrimination law is wider than in other employment law eg unfair dismissal.

I think there was also an issue on possible time bar as well that the ET were considering?

will it just be on the usual ET decisions gov page does anyone know?

I personally thought the Respondent’s arguments about employment status were far too dependent on the rules in the US, not the UK. Same with WORIADS.

But I guess we’ll see in a few hours.

I wonder even if she is found not to be an employee on a technicality, can the judge still provide a view on the necessity of employers being clear on how people with gender critical views can express these views in the workplace.

If we are forced to celebrate pride by our employers (the screen on my computer is all Pride colours for the month of June), then they have brought gender identity politics into the workplace and they absolutely should be required to allow a space for people with different views.

Excellent. There are key areas that need to be explored and it’s finally starting to happen.

And yes, I hope workplaces starting rethinking all the political slogans and symbols being forced onto their employees, especially places like councils and schools. It’s insidious and wrong.
