If she loses, it will be on the basis that she wasn’t an employee / didn’t have employment rights.

I couldn’t see that her employment rights status was established convincingly in the tribunal evidence.

However if the tribunal do find her to have had employment rights, then I’ll be amazed if she doesn’t win.

caveat: IANAL

This is the worry. If she loses on employment status, I wonder if they still go on to decide whether or not discrimination occurred in case the employment part is appealed?

Am I right in thinking that Maya and her lawyers will already have sight of the judgement? And that it is embargoed until 11am tomorrow so that she can't comment yet?

I'm hoping she will be able to post her own summary/opinion on the Sex Matters website, as well as the whole judgement, at some point tomorrow or this week.

Cripes, the day is nearly here. I have been thinking about this and waiting - how must it be for Maya? Absolutely everything crossed for her. Her initial result for the first part has made such a difference for everyone. She deserves this.

I hope she wins, she deserves it.

It'll be shit if she loses, and I can see now how the technicalities of the tribunal (i.e that she lost because she was not technically employed anymore anyway so discrimination laws didn't apply) will be completely buried by TRA hyperbole like "Terfs lose tribunal because they're like Nazis and want to kill us all".

Maybe I'll have a bit of fun predicting what they'll come up with.

"Terf loses employment case, this means transwomen are women after all"

Oh lord, maybe she gets it at 9am or something, released at 11? Very nerve-wracking.

I think there will be some wins in the judgement. I'm hopeful. I thought the respondents were very poor all round.

I truly do hope that you win, but if it turns out that you don’t (as others have said, maybe because of the issue around technicalities of employment), the beautiful sunlight that your case sent spilling everywhere has been brilliant. It’s meant so much to so many people, and it has exposed the chicanery, authoritarianism and moral cowardice of your employers and those like them who want to stifle womens voices.

Oh God I can't cope!

As its been such a long time I really hope that even if she loses on the employment status, the judgement goes through all the other aspects and we get a good analysts and a statement that she eoukd have been successful on those bits.

I'm keeling my fingers crossed. We'll done maya & legal team. We have come so far and you did that!

As mentioned by a PP, Maya could lose on the technicality that she was not an employee. That shouldn’t in any way undermine the impact of the EAT ruling that GC beliefs are worth my of protection.

However, the ET also has to decide whether what Maya actually said went beyond what is acceptable and worthy of protection- the EAT made clear that GC people don’t have carte blanche to eg harass/attack trans people. Obviously if Maya loses on this front that is far more of a blow, but would not alter the point of principle that respectfully expressed GC views are protected in law.

I think it’s likely Maya and her team have had the embargoed judgment for a day or two but I don’t know for sure if that’s how it works in the ET.
