Whilst it may be obvious to all but the brainwashed, that JY is deliberately using 2 identities in order to misrepresent themself into falsely tricking someone into providing a service which they would otherwise not be allowed, the shocking fact is that Canada has fully bought into this madness.
I feel sorry for the poor Sikh woman who is an innocent bystander in this farce, and stands to lose a lot if common sense doesn't prevail.
At the the moment, common sense seems to be in short supply.

This case will set a precedent in a legal system that relies on precedent. That it is barely being reported is chilling.

I am surprised it doesn't seem to have been mentioned in court yet that had the female defendant proceed to wax JY, this could have resulted in serious injury. Male intimate waxing is an entirely different skill.

My understanding is that someone accusing of a human rights breach pays nothing.
The accused must pay to defend themselves. Down on the farm the discussion stated that in USA a fee exists to stop serial litigators like JY. In Canada he can operate with impunity. Let's not forget he's been bringing complaints against anyone he doesn't like for years.

Just as a note, this is not the “Canadian authorities”. This is not a federal matter. This is the British Columbia Human Rights Tribunal which has authority under the provincial B.C. Human Rights Code. It is also not a court but an administrative tribunal so has little precedential value outside of other similar fact situations in that same tribunal (ie JYs other complaints).

No, JY does not have to have legal representation in that forum and thus it is free to make a complaint but I think the usual applies: if the other side gets legal counsel you are foolish not to do the same. And the tribunal can award costs for improper conduct etc so we will see how JY holds himself.

I believe that is the implication, yes. Doing this has been discussed on other transgender sites. I think this option did not initially occur to the defendant’s lawyer or the sitting Member though since they had to then find a way to discuss JY’s genitals to understand what was happening there. Confused

I hope the lying and being female when it suits but being offended at being called male when being male also serves a purpose for JY is picked up on.

Vexatious nature and being opportunitistic chancer happy to abuse a situation are the key things here not gender.

Thanks. So bringing an action here can be financially as well as emotionally oppressive? I hope the tribunal takes all that into account (assuming they see sense at all).

Just like to point out that it's not just this 1 woman. There are 16 others currently being sued by this person and many others who have settled out of court for a quiet life.

It sounds like there is some confusion or false assumptions about intersex in the court. Is the court member the magistrate/judge? I hope she decides that genitals are central to the case so exactly what the accuser has is material and they can't hide behind privacy.
