This case is asking for a legal precedent to be set as to whether gender identity takes precedent over all other protected characteristics and women's rights

If JY wins that the beauticians still have the right to say waxing a penis and scrotum is not a service they provide.The refusal has nothing to do with protected characteristics. It never was. They don't provide this service to any body with that configuration. Having that configuration is not a disability.

It's no different from a basic barber shop saying, sorry I don't do that fancy highlight thing involving tin foil- not because of your "protected characteristic" but because I don't know how to and don't want to learn how to.

I agree Lass , you'd think it's an open and shut case, but JY is pressing the view that conflict with religion should not be considered as a valid reason to 'opt out' as JY puts it. JY is asking for a hierarchy of need that puts trans at the top as the trump card.

I had thought that this would be as simple as you say: not a service provided by this business. But the court seem to be allowing all kinds of debate and bullshit into this situation. I don't understand why.

UK law puts disability over religion (Muslim taxi driver refusing to take a guide dog was discrimination)

I read the Twitter thread- perhaps it was a mistake emphasising the beautician was a Sikh rather than a beautician with no relevant expertise and training. You can't be forced to provide a service where you have no competency.

The reporting restrictions are ridiculous. The world and its spouse knows who JY is.

If the person bringing the complaint is, even to this arm chair psychiatrist, bat shit, e.g. citing examples of menstruation which is irrelevant to their case, and the twitter trail showing that they are clearly a bit of a worry - don't they have a duty of care to have ht complainant assessed before putting them up int he legal system?

I mean. It's just so nonsensical.

I wonder if the court is taking it so seriously so that when (I hope) the case is thrown out and JY has to pay substantial damages; there will be no grounds for appeal.

From the tweets - which are clearly taken from notes after each day's proceeding it is important to say - it seems that JY is being given a lot of opportunities to make his case as clearly and in as much detail as he demands. He is being given quite a bit of guidance & help from the "Member" - the person presiding over the hearing, who sounds wise & compassionate.

I'm hoping he's being given enough rope to hang himself, as they say. BTW, of course I don't really believe anyone should hang themselves or be hanged!

JY is ill and I can only imagine how his parent must feel. It's so sad.

There must be other trades where there isn't necessarily a qualification (or there is but not everyone has a formal qualification) but tradespeople draw the line because it is outwith their competency.
