I didn't realise Miranda Yardley was in court today over alleged transphobic harrasment.

At Basildon Magistrates Court where Miranda Yardley is on trial for transphobic Harassment. The prosecution applied for reporting restrictions to prevent the complainant Helen Islan from being named. The judge has not granted them. So Helen Islan can be named.

Be really interesting to see how Mermaids deal with the 'Helen situation' from now on.

  1. Be publicly supportive of Helen and the Mermaids brand will be repeatedly tainted by the judge's "case should never have been brought" comments. That makes two judges who have been critical of Mermaids (the other a family court judge in a custody case).
  1. Denounce Helen and she might go off telling tales in public about just exactly what Mermaids have been up to.
  1. Say nowt in public but try that difficult balance of keeping Helen onside in private, keeping her away from any public-facing roles, and hope that Helen keeps her big fat gob shut.

They'll go for 3. But Helen doesn't seem the type to embrace the background non-speaking role. The naming of her publicly in this case may have had a sobering effect though.

Well it's certainly getting a good dose of sunlight shone on it now....

I'm concerned they'll just keep bringing these worthless cases against outspoken gender critical women and transexuals, until they get a legal precedent. TRAs are pushing the hate speech laws so much - they want to silence women from speaking out, and they'll be able to silence us if we no longer have the language to do so, because such language is 'hate speech".

This case is a massive blow to the TRAs though.

I think either or both Susie and Helen may come to rue the day they got their big Lottery grant. Looking into the accounts filed at the Charities Commission they were a pretty tinpot organisation run on a shoestring - albeit with impressive reach and influence.

They now have real money, which brings with it responsibility. It also probably means "professional" charity staff from the LGBT merry go round.

I think there will be a fall out from these growing pains, rather than from this case. Mermaids is Susie's baby. Her validation. I predict it will end messily.

Also, the fucking hypocrisy of someone who was an expert witness for a rape fantasy "author" defending "the rights of every individual in the UK in terms of how they express themselves" now casting doubt on this judgment.

That letter from Mishcon de Reya is pretty nasty. I assume once the CPS decided to prosecute, Helen dropped her private action?

Interesting that Helen was only a volunteer with Mermaids, not a paid employee.

This is an issue that will be resolved in the courts imo. The problem is that not enough cases are making it to court. At the moment there are pressure groups misstating what the law is and woke public authorities misapplying the law. The courts have to apply the actual law.
The FOI requests are interesting - I'd be interested to know how the evidentiary and public interest thresholds were deemed to have been met too.

If the CPS has any sense at all - and who knows if it has - it will think very very carefully before bringing another ridiculous prosecution based on the hurt feelz of a TRA. There may be private prosecutions, of course - but look at how that worked out for Giuliana. One hopes that at some point a senior judge will publicly pronounce that it has all got out of hand.
