I didn't realise Miranda Yardley was in court today over alleged transphobic harrasment.

At Basildon Magistrates Court where Miranda Yardley is on trial for transphobic Harassment. The prosecution applied for reporting restrictions to prevent the complainant Helen Islan from being named. The judge has not granted them. So Helen Islan can be named.

I posted this earlier but for those that missed it there appears to be demands on IPSO that thee should be special protection from the press for some minority groups, including, apparently protection against "transphobic articles by UK news media".

Most of the press are not keen on anything that curtails the freedom of the press. I think there will be much interest in this case. And it may we'll represent something of a watershed. I hope.

I'm wondering if the CPS are now so fed up with all the ridiculous reports from compliant police forces that they actually chose to run with this one, knowing it could never stand up to evidential examination (just like all the similar reports they've had to look at), in order to make a very clear point to those forces who make the referrals.

By "terfs" presumably Rachel McK means the judge, the lawyers... and so on.

That comment is just bonkers. She was "pushing charges" - that's why it was in court! Having your case thrown out because there's no case to answer isn't being intimidated into not "pushing charges", fgs.

On the question of costs, from what I can gather (IANAL) Miranda has been awarded costs which the CPS are liable for. However this will only be at the legal aid rate.

Defendants in criminal trials are eligible for legal aid, including representation, depending on income.

If Miranda got full legal aid, all the awarded costs could be recouped by the Lord Chancellor.

If he got partial legal aid, that part could be recouped and Miranda gets to keep what's left over towards what he spent.

If he got no legal aid (income too high or didn't apply), Miranda gets to keep the whole costs award but it probably won't come anywhere near what he spent.

I was thinking the same as BettyFloop. CPS might well have refused to prosecute in other cases, and so were under increasing pressure to do something about this 'trasphobia'. And are now sitting in a pub somewhere toasting whoever and saying 'we told you'.
