Am I getting this right? The labour party can not use their office to trawl through social media and collect evidence against members. Cos that would be illegal.
But if an individual made a complaint against Labour or a Labour officer doing the same, using evidence from social media, thats not a breech of data protection as the individual doesn't have the responsibility to protect data and is showing up a breech of trust. But the Labour Party has a duty of care under the DPA to use this evidence from social media
to investigate due to the complaint and abuse of power.
So anyone in office using their office to investigate other members without an official complaint is not compliant with DPA unless they are upholding the DPA (or another law). And even then unless its directed at particular individuals and isn't criminal in nature (harassment or hate) then Labour also can't use it against them cos of the DPA as they haven't given permission for that data to be collected against them.

If I'm right, then its ok to hold an opinion and office and campaign as long as you don't target individuals to a criminal level or abuse your power by collecting data or using Labour Party data.
Its ok to express and campaign for an issue as a member as long as its does involve criminal behaviour.
Its not ok, to harass individuals (because thats criminal) and if thats done the individual has to lodge a proper complaint - it can't be done on the behalf of someone. And its not ok to collect information in the form of a dosier or file on members in an official capacity and its dodgy if you hold any official role in Labour unless authorised by the member to collect that information or Labour is investigating something which they have a legal responsibility or concern about.
