Oh I've just come to this thread - I'm so impressed by the activism and the result -

Can't believe it is from Lord Denning - actually if they put it on the plaque that it was a quote by a senior judge that would actually show how awful it was.

Denning was a bit crazy. He just randomly invented bits of law. The senior judiciary tend to be about 30 years behind the rest of us (a few exceptions).
