I'm not saying at all that 'he didn't mean it' is an excuse for rapists - I'm saying that if someone feels harassed it doesn't mean that the accused intended to harass just that he did. This isn't a rape case so equating the two is silly - stealing a loaf to eat is not the same as armed robbery with violence so to debate 'stealing' using armed robbery to illustrate why stealing a loaf is wrong is patently idiotic! Unfortunaely in assuming that a disciplinary process is fair, you are falling into the trap that media, other employees and even the accused can fall into, i.e. that the outcome of a disciplinary process reflects fact - it doesn't. Disciplinary processes are usually 'we think this is true about you, if you think it isn't we will argue with you, and then decide your evidence is inconsistent with our argument' they are not about deciding the best collaobrative solution or weighing up two arguments and finding the mid-point, they are about formalising the accusation and arguing with any contradictions.
