At the end of August, there was a partial rejection of the ARO trademark because of the name and descriptions. Also issues with the logo.
They had 3 months to rectify, which you would think would be ample time.

But just a few days before the deadline, an extension has been applied for. Which would be another 3 months

So it’s obviously not an easy fix, I’m sure there have been countless people working to get this done and they have months! Yet they’ve not been able to sort it.

Seemingly, you are only allowed one extension. This would take her to the end of February. So pretty much a year since she’s launched and it’s no further forward, if anything she’s in a worse position. What a disaster.

A 'source' for Meghan has reported that Meghan is furious with her legal team for the screw ups with the trademark, she is threatening to fire them. Meghan is apparently embarrassed that her lawyers can't get a 'simple trademark over the line'.

So Meghan seems to have the same view as most of the posters here, albeit throwing her legal team under the bus..

Meghan really needs to stop pressing the whole 'Attention to detail' and 'Perfectionist' nonsense. There would be sympathy instead of ridicule for all the failures if she wasn't constantly demonstrating her superiority complex.

Sounds about right.

But the legal team were on a hiding to nothing.

The trademark lawyer I quoted above stated that it was unlikely to ever be granted and couldn’t understand why they pressed ahead with it, never mind actually launching the business with the name.

She’s clearly picked the name, never listened to advice and pushed her team to get it through. Now she’s blaming them

Once again, disclaimers are routine. William and Kate had to issue a disclaimer after their trademark was actually refused in May this year, they have it now.

I don’t understand why this is so complicated 🤷🏽‍♀️

THE ROYAL FOUNDATION OF THE PRINCE AND PRINCESS OF WALES

In America.

They went through a lengthy back and forth process, even got refused once.

(Note that ARO has not been refused) just a non final action.

The trademark was later accepted.

Of course no one creates a thread about it lol

“In its reasoning for partially rejecting the application, the USPTO described how the term ‘American Riviera’ is a nickname for Santa Barbara, California. This, combined with the fact that the Duchess of Sussex has a nearby residence – which would likely lead the consumer to conclude that the area was the origin of the products – led the USPTO to refuse the application because it is geographically descriptive”

@smilesy the disclaimer was that William and Kate don’t have the right to the word ‘Foundation’ just like Meghan’s disclaimer will be not having the right to ‘American Riviera’ which is not an issue.

Nope, note on the prosecution history, unlike William and Kate who had a full refusal.

Time will tell. The proof will be in the pudding in years to come. I’m sure everyone, fan or non-fan of the couple, wish only a happy childhood on the children. If they grow up well rounded and not pursue empty fame for its own sake then no one can criticise that.

They’ve had a partial refusal over the name. They cannot get around the geo description, therefore will not be able to get a TM

I have no idea what Kate and William have tried to TM. I have never once commented on such.

That’s all people need to do, wish the children well. That’s it.

It’s the faux concern over the children of a man and woman they mock and abuse everyday.

Using that same fake concern to cast aspersions. That’s what I find ugly.

A company that launched 9 months ago, have had a refusal over the name they’ve tried to TM and have zero products. No income, no turnover, no profits.

It’s an unmitigated disaster.

Some people just can’t accept reality and are very very upset about it

I think William and Catherine applied for the trademark PRIOR to registering their foundation in the US, I imagine that would be the normal way to do things, just so you don't look like you don't know WFT you are doing. Makes more sense to do it that way to iron out any potential issues in advance.
